全国人大常委会:中华人民共和国生态环境法典(草案)

Standing Committee of the National People’s Congress: Code of the People’s Republic of China on Ecological and Environmental Protection (Draft)

法典梳理了生态环境保护领域现行的30多部法律、100多件行政法规、1000多件地方性法规以及党的十八大以来生态文明法治实践成果,进行系统整合、编订纂修和集成升华。

生态环境法典草案分为总则编、污染防治编、生态保护编、绿色低碳发展编、法律责任和附则编共五编,总计1188条款:

-污染防治编:整合了大气污染防治法、水污染防治法、土壤污染防治法等多部法律。有9个分编、525条,第九分编“其他污染防治”增加了化学物质污染风险管控、电磁辐射污染防治和光污染防治,填补现行法的空白。

-生态保护编:包括一般规定、生态系统保护、自然资源保护与可持续利用等内容。整合了森林法、草原法、湿地保护法等法律中有关生态保护的内容,并增加江河湖泊、荒漠生态系统的专门规定

-绿色低碳发展编:涵盖应对气候变化、碳达峰碳中和、绿色低碳发展等方面的内容。

法律责任和附则编:明确了违反法典规定的法律责任,以及法典的适用范围、解释权等。

生态环境法典草案形成了一个逻辑严密、层次分明的有机整体,消除了法律规范之间的冲突和矛盾,提高生态环境法律体系的系统性、协调性和统一性。填补了某些立法空白,提升了生态环境立法的位阶和权威性,方便生态环境法律的执行与遵守。法典化还有利于国际交流与合作并增强国家法治影响力。

The Code systematically consolidates, compiles, and elevates more than 30 existing laws, over 100 administrative regulations, more than 1,000 local regulations in the field of ecological and environmental protection, as well as the achievements in the rule of law for ecological civilization since the 18th National Congress of the Communist Party of China.

The Draft Code on Ecological and Environmental Protection is divided into five sections: General Provisions, Pollution Prevention and Control, Ecological Protection, Green and Low-Carbon Development, and Legal Liability and Supplementary Provisions, comprising a total of 1,188 articles.

-Pollution Prevention and Control Section: This section integrates multiple laws, including the Law on the Prevention and Control of Atmospheric Pollution, the Law on the Prevention and Control of Water Pollution, and the Law on the Prevention and Control of Soil Pollution. It consists of 9 sub-parts and 525 articles. The ninth sub-part, titled “Other Pollution Prevention and Control,” adds provisions on the risk management of chemical pollution, prevention and control of electromagnetic radiation pollution, and light pollution, thereby filling gaps in the current legal framework.

-Ecological Protection Section: This section includes general provisions, ecosystem protection, and the conservation and sustainable use of natural resources. It integrates provisions related to ecological protection from laws such as the Forest Law, Grassland Law, and Wetland Protection Law, and adds specific regulations on river, lake, and desert ecosystems.

-Green and Low-Carbon Development Section: This section covers areas such as response to climate change, carbon peaking and carbon neutrality, and green and low-carbon development.

-Legal Liability and Supplementary Provisions Section: This section specifies the legal liabilities for violations of the Code’s provisions, as well as the scope of application, the right of interpretation, and other related matters of the Code.

The Draft Code on Ecological and Environmental Protection forms a logically rigorous and well-structured organic whole, eliminating conflicts and inconsistencies among legal norms and enhancing the systematization, coordination, and consistency of the ecological and environmental legal framework. It fills certain legislative gaps, elevates the status and authority of ecological and environmental legislation, and facilitates the implementation and compliance of environmental laws. Codification also promotes international exchange and cooperation, while strengthening the influence of the rule of law at the national level.

市场监管总局:集中用餐单位落实食品安全主体责任监督管理规定‍

State Administration for Market Regulation: Provisions on the Supervision and Administration of the Implementation of Food Safety Responsibilities by Centralized Dining Units

为更好管控集中用餐单位的食品安全风险,从2022年的《企业落实食品安全主体责任监督管理规定》(国家市场监督管理总局令第60号)将集中用餐单位的部分分离出来,细化了对集中用餐单位、单位食堂、承包经营企业、供餐单位,从责任分配、风险防控机制、食品安全管理人员配备和任职要求、法律责任等方面的规定。

明确要求单位食堂、承包经营企业、供餐单位须严格落实“日管控、周排查、月调度”工作制度,依法配备食品安全总监和食品安全员。食品安全总监、食品安全员每年参加培训时间不少于40小时。集中用餐单位从供餐单位订餐的,须查验所订购食品。

To better manage food safety risks in centralized dining units, certain provisions concerning these units were separated from the 2022 Provisions on the Supervision and Administration of the Implementation of Main Responsibility for Food Safety by Enterprises (Order No. 60 of the State Administration for Market Regulation). The new provisions provide more detailed rules for centralized dining units, workplace canteens, contracted operators, and food suppliers, covering areas such as responsibility allocation, risk prevention and control mechanisms, staffing and qualification requirements for food safety personnel, and legal liability.

The provisions clearly require that workplace canteens, contracted operators, and food suppliers must strictly implement the “daily control, weekly inspection, and monthly scheduling” work system, and legally appoint a food safety director and food safety personnel. The food safety director and food safety personnel must participate in no less than 40 hours of training each year. For centralized dining units that order food from suppliers, the food ordered must be inspected.

市场监管总局:食品生产经营企业落实食品安全主体责任监督管理规定

State Administration for Market Regulation: Provisions on the Supervision and Administration of Food Production and Operation Enterprises in Fulfilling Their Primary Responsibility for Food Safety

本规定修正自2022年的《企业落实食品安全主体责任监督管理规定》(国家市场监督管理总局令第60号)。

在适用范围上,新规定将集中用餐单位的部分剥离出去,明确了食品生产经营企业及相关人员在落实食品安全责任方面的行为细则,并将从事特殊贮存业务的非食品生产经营者纳入范围。

新规细化了监管要求,更新了主要负责人的职责、食品安全总监和食品安全员的定义,要求食品安全总监的角色必须是企业管理层的人员,以确保在决策层面上做好食品安全的把控。

另外,规定要求食品安全总监和食品安全员每年必须参加不低于40个小时的培训。‍The provisions were amended from the 2022 Provisions on the Supervision and Administration of Enterprises in Fulfilling Their Primary Responsibility for Food Safety (Order No. 60 of the State Administration for Market Regulation).

In terms of scope of application, the new provisions exclude certain provisions related to centralized dining units and clarify the detailed rules for food production and operation enterprises, as well as related personnel, in fulfilling their food safety responsibilities. The new provisions also incorporate non-food producers and operators engaged in special storage businesses into the scope of application.

The new provisions refine supervisory requirements and update the responsibilities of key personnel,the definitions of the food safety director and food safety personnel, requiring that the food safety director must be a member of the enterprise’s management team to ensure effective control of food safety at the decision-making level.

In addition, the regulations mandate that both the food safety director and food safety personnel must participate in no less than 40 hours of training annually.

市场监管总局:关于印发场(厂)内专用机动车辆使用安全治理等三个行动方案的通知

State Administration for Market Regulation: Notice on Issuing Three Action Plans Including the Safety Management of Special Motor Vehicles Used Within Premises (Factories)

通知印发了《场(厂)内专用机动车辆使用安全治理行动方案》、《锅炉安全提升行动方案》和《客运架空索道风险隐患排查治理行动方案》。

通知要求各地相关企业对照方案自查自纠,2025年8月31日前完成整改。自2025年9月1日起,各地市场监管部门要加强对方案落实情况的检查。

要求2025年12月31日前,阶段性完成违法生产使用小型锅炉专项整治。2026年12月31日前,完成电站锅炉安装质量专项整治。

The notice issues the following three action plans: the Action Plan for the Safety Management of Special Motor Vehicles Used Within Premises (Factories), the Action Plan for Enhancing Boiler Safety, and the Action Plan for Risk and Hazard Investigation and Management of Passenger Aerial Ropeways.

The notice requires relevant enterprises in all regions to conduct self-inspections and rectifications in accordance with the action plans, with corrections to be completed by August 31, 2025. Starting from September 1, 2025, local market regulation authorities must strengthen inspections on the implementation of the plans.

It also requires that the special rectification of illegal production and use of small boilers be substantially completed by December 31, 2025, and the special rectification of installation quality of power station boilers be completed by December 31, 2026.

生态环境部:关于做好2025年全国碳排放权交易市场有关工作的通知

Ministry of Ecology and Environment: Notice on Effectively Conducting Relevant Work for the National Carbon Emissions Trading Market in 2025

通知要求2025年6月30日前,钢铁、水泥、铝冶炼行业重点排放单位完成2024年度温室气体排放报告报送工作。对于年度直接排放量达到2.6万吨二氧化碳当量的独立电炉短流程钢铁生产企业等按照本通知附件3所列的核酸报告与核查技术规范,开展年度温室气体排放报告和核查工作。其中,2024年度温室气体排放报告提交截止日期由2025年3月31日调整至6月30日。

2025年12月31日前,发电、钢铁、水泥、铝冶炼行业重点排放单位按时足额完成2024年度碳排放配额清缴。

The notice requires key emission units in the steel, cement, and aluminum smelting industries to complete the submission of their 2024 annual greenhouse gas emission reports by June 30, 2025. Independent electric furnace short-process steel production enterprises with annual direct emissions reaching 26,000 tons of carbon dioxide equivalent shall carry out annual greenhouse gas emissions reporting and verification in accordance with the accounting reporting and verification technical specifications listed in Appendix 3 of this Notice.The deadline for submitting the 2024 annual greenhouse gas emission report has been adjusted from March 31, 2025, to June 30, 2025.

Before December 31, 2025, key emission units in the power generation, steel, cement and aluminum smelting industries shall complete the settlement of carbon emission quotas for 2024 on time and in full.

生态环境部等五部门:中国履行〈关于消耗臭氧层物质的蒙特利尔议定书〉国家方案(2025-2030年)

Ministry of Ecology and Environment and Other Four Departments: Chinese National Implementation Plan for the Montreal Protocol on Substances that Deplete the Ozone Layer (2025–2030)

《国家方案》确定的管控物质包括全氯氟烃(CFCs)、哈龙、四氯化碳、甲基氯仿、含氢溴氟烃、溴氯甲烷、甲基溴、含氢氯氟烃(HCFCs)和HFCs共9类物质。前8类物质是对臭氧层有破坏作用的ODS,第9类物质HFCs对臭氧层无破坏作用,是具有高全球升温潜能值(GWP)的温室气体。

目前,我国已实现CFCs、哈龙、四氯化碳、甲基氯仿、含氢溴氟烃、溴氯甲烷、甲基溴等7类ODS受控用途生产和使用的全面淘汰,正在逐步削减淘汰HCFCs和HFCs。按照议定书有关要求,国家方案明确了以下履约目标:

  • 持续禁止已淘汰ODS受控用途生产和使用。
  • HCFCs受控用途生产量和使用量在2025年分别削减基线值的67.5%和73.2%,2030年均削减基线值的97.5%。
  • HFCs受控用途生产量和使用量在2029年均削减基线值的10%。

国家方案提出加强源头管控,严格管理管控物资的生产和销售;加强过程控制,强化管控物资使用管理;完善末端治理,加强维修、回收、再生利用和销毁管理;以及加强进出口管理,防范管控物资贸易风险4大行动举措,并制定了11项具体任务。

The substances controlled by the National Implementation Plan include nine categories: Chlorofluorocarbons (CFCs), halons, carbon tetrachloride, methyl chloroform, hydrobromofluorocarbons, bromochloromethane, methyl bromide, hydrochlorofluorocarbons (HCFCs) and HFCs. The first eight substances are ozone-depleting substances (ODS) that harm the ozone layer, while the ninth substance, HFCs, does not deplete the ozone layer but is a greenhouse gas with a high global warming potential (GWP).

At present, China has achieved the complete elimination of the production and use of seven types of ODS controlled purposes, including CFCs, halons, carbon tetrachloride, methyl chloroform, hydrobromofluorocarbons, bromochloromethane, and methyl bromide, and is gradually reducing and phasing out HCFCs and HFCs. In accordance with the relevant requirements of the protocol, the national plan clearly defines the following compliance targets:

lContinuously prohibit the production and use of controlled ODS (ozone-depleting substances) in phased-out applications.

lReduce the production and use of HCFCs in controlled applications by 67.5% and 73.2% from baseline levels by 2025, and by 97.5% from baseline levels by 2030.

lReduce the production and use of HFCs in controlled applications by 10% from baseline levels by 2029.

The national plan proposes four major action measures: strengthening source control by strictly managing the production and sale of controlled substances; enhancing process control by strengthening the management of controlled substance usage; improving end-of-life management by strengthening maintenance, recycling, regeneration, and disposal management; and enhancing import and export management to prevent trade risks associated with controlled substances. Additionally, 11 specific tasks have been outlined.

中国气象局:防雷减灾管理办法

China Meteorological Administration: Administrative Measures for Protecting against and Mitigating Thunder and Lightning Disasters

办法修订了2011年《防雷减灾管理办法》(中国气象局令第20号)。

修订中主要完善和增加了防雷安全重点单位管理制度,授权各省(自治区、直辖市)气象主管机构结合本地实际制定和公布防雷安全重点单位目录清单。明确各级气象主管机构应当加强雷电灾害预警系统和防雷安全信息化监管平台的建设工作,提高雷电灾害预警和防雷减灾服务能力。

删除了原办法第三章防雷工程专业设计和施工资质条款,改为新建、改建、扩建建设工程雷电防护装置的设计、施工,可由取得相应建设、公路、水路、铁路、民航、水利、电力、核电、通信等专业工程设计、施工资质的单位承担,与《气象灾害防御条例》相关表述保持一致。落实国家取消“防雷产品测试”的要求,删除了原办法防雷产品测试的规定。 

The Measures revise the 2011 Administrative Measures for Protecting against and Mitigating Thunder and Lightning Disasters (Order No. 20 of the China Meteorological Administration).

The revisions primarily improve and expand the management system for key units in lightning protection safety, authorizing meteorological authorities at the provincial (autonomous region and municipality) level to develop and publish directories of key lightning protection units based on local conditions. The measures also specify that meteorological authorities at all levels should strengthen the development of lightning disaster early warning systems and lightning safety information supervision platforms, in order to enhance the capacity for lightning disaster warning and lightning protection services.

The original Chapter III provisions on professional qualifications for lightning protection engineering design and construction have been deleted. Instead, the design and construction of lightning protection installations for newly built, renovated, or expanded construction projects may be undertaken by entities holding relevant professional engineering design and construction qualifications in fields such as construction, highways, waterways, railways, civil aviation, water resources, electricity, nuclear power, and telecommunications—ensuring consistency with the relevant provisions of the Regulation on the Defense against Meteorological Disasters. In line with the national policy to eliminate “lightning protection product testing,” the provisions on testing of lightning protection products in the original measures have also been removed.

生态环境部:排污单位生产设施及污染治理设施用电监控技术指南(征求意见稿)

Ministry of Ecology and Environment: Technical Guideline for Electricity Surveillance for Production Facilities and Pollution Treatment Facilities of Pollution Sources (Consultation Paper)

本标准征求意见稿规定了排污单位生产设施及污染治理设施用电监控系统的系统结构与功能要求、安装技术要求、安全规范性要求、验收技术要求、日常运行维护与校准要求和数据应用,提供了判断生产设施及污染治理设施的运行状态的方法。适用于指导排污单位生产设施及污染治理设施用电监控系统的建设和应用。

The Consultation Paper of the standard specifies the system structure and functional requirements, installation technical requirements, safety and regulatory requirements, acceptance testing requirements, routine operation, maintenance and calibration requirements, and data application for electricity consumption monitoring systems of production facilities and pollution control facilities at pollution discharge units. It provides methods for determining the operational status of production and pollution control facilities, and is applicable for guiding the construction and application of electricity monitoring systems for such facilities at pollution discharge units.

市场监管总局:特种设备使用管理规则(修订稿)

Administration for Market Regulation: Special Equipment Service Administration Regulation (Revision)

本规则适用于《特种设备目录》范围内特种设备的安全与节能管理。

相比TSG 08-2017特种设备使用管理规则,该修订稿增加了《特种设备使用单位落实使用安全主体责任监督管理规定》作为法律依据,新增了“使用管理基本要求”章节,细化了特种设备使用单位在安全管理方面的具体要求,包括建立安全风险分级管控和隐患排查治理双重预防机制,制定《特种设备安全风险管控清单》,并建立日管控、周排查、月调度的工作制度等要求。

修订稿取消了安全管理负责人和安全管理员,调整为安全总监和安全员。优化了使用登记的程序,明确要求使用单位优先采用网上申报系统进行登记,简化了材料提交和审核流程。

Compared to the TSG 08-2017 Special Equipment Service Administration Regulation, this revision incorporates the Regulations on the Supervision and Management of Special Equipment Use Units to Fulfill Safety Responsibilities as a legal basis. It introduces a new chapter on “Basic Requirements for Use Management,” detailing specific safety management requirements for special equipment use units. The requirements include establishing a dual prevention mechanism for safety risk grading control and hazard investigation and rectification, formulating a Special Equipment Safety Risk Control List, and implementing a work system of daily control, weekly inspections, and monthly scheduling, among other requirements.

The revised draft cancels the positions of safety management officer and safety administrator, replacing them with safety director and safety officer. It optimizes the registration process, explicitly requiring that use units prioritize the online declaration system for registration, and simplifies the materials submission and review processes.

上海市:关于印发2025年上海市节约用水和水资源管理工作要点的通知此通知

Shanghai Municipality: Notice on Issuing the Key Points of Water Conservation and Water Resources Management Work in Shanghai for 2025

在节约用水方面提出了12项工作要点。计划开展火电、钢铁、宾馆、高校等用水定额对标达标。积极推广水务经理制度,鼓励年用水量超过10万立方米的工业企业设立水务经理,指导企业节约用水专业化规范化管理。持续推进绿化浇灌自来水替代试点建设,鼓励企业积极参与重点用水企业和公共机构水效领跑者遴选活动,提升用水效率。

水资源管理方面提出了17项工作要点。

Twelve key tasks have been outlined for water conservation. These include launching benchmarking and compliance programs for water consumption quotas in sectors such as thermal power, steel, hotels, and universities. The promotion of a water affairs manager system is encouraged, with industrial enterprises using over 100,000 cubic meters of water annually urged to appoint water affairs managers to guide professional and standardized water-saving management. The city will continue advancing pilot projects to replace tap water with alternative sources for landscape irrigation. Enterprises are also encouraged to actively participate in the selection of top-performing water-efficient enterprises and public institutions to improve overall water use efficiency.

Seventeen key tasks have been proposed for water resources management.

上海市:上海市2025年碳达峰碳中和及节能减排重点工作安排

Municipality: Key Work Plan for Carbon Peaking, Carbon Neutrality, and Energy Conservation and Emission Reduction in 2025

通知发布了《2025年全市节能减排降碳工作主要目标》、《2025年各区节能目标》、《2025年重点企业煤炭控制目标》和《2025年碳达峰碳中和及节能减排重点工作任务和分工表》,同时推出了十六项重点工作安排。

要求进一步完善两高项目联合评审机制,做好源头管控,当所属区或所属领域未完成能耗双控目标进度时,单位产值能耗超过全市工业平均水平的新建两高项目,实施缓批限批,暂停节能审查批复。

The notice released the Main Targets in Shanghai for Energy Conservation, Emission Reduction, and Carbon Reduction in 2025, the 2025 Energy Conservation Targets for Each District, the 2025 Coal Consumption Control Targets for Key Enterprises, and the Table of Key Tasks and Division of Responsibilities for Carbon Peaking, Carbon Neutrality, and Energy Conservation and Emission Reduction in 2025. Meanwhile, sixteen key work initiatives were introduced.

The notice calls for further improvement of the joint review mechanism for high energy-consuming and high-emission (“two-high”) projects, emphasizing strict source control. If the relevant district or sector fails to meet the progress targets for the dual control of energy consumption and emission, newly proposed two-high projects with energy consumption per unit of output exceeding the citywide industrial average will be subject to delayed or restricted approval, and the energy-saving review and approval process will be suspended.
