国务院:节约用水条例

The State Council: Regulations on Water Conservation

国务院近日公布《节约用水条例》。《条例》是在1988年国家颁布的《城市节约用水管理规定》基础上的重大革新,为城市节约用水工作提供了顶层设计和根本原则。条例建立了一系列符合城市节水工作实际的制度,从建立节水机制、加强用水管理、完善节水措施、强化保障和监督等方面提出52条举措,是我国第一部专门关于节约用水的行政法规。

《条例》对用水的全过程进行了细致的划分并做出了明确规定,内容涵盖了节水规划、定额制定、计量和供水等各个方面,实现水资源的精细化管理和高效利用。特别是通过制定用水定额,明确了各行业、各领域用水的标准和限额,为节水提供了量化的依据和目标。

另外,《条例》从工业、农业、生活等多个方面提出了综合性的节水措施。在工业领域,要求工业企业应当加强内部用水管理,建立节水管理制度,鼓励企业采用先进的节水技术和设备,实现循环用水和废水回用,提高水资源重复利用率。高耗水工业企业用水水平超过用水定额的,应当限期进行节水改造。明确提出工业企业应回收利用生产设备冷却水、空调冷却水、锅炉冷凝水;高耗水工业企业应当逐步推广废水深度处理回用技术措施。

The State Council recently published the “Regulations on Water Conservation”. The “Regulations” has made significant amendment to the “Administrative Regulations on Urban Water Conservation” promulgated in 1988, providing a top-level design and fundamental principles for urban water conservation work. The “Regulations” establish a series of systems in line with the actual situation of urban water-saving work, and put forward 52 measures in terms of establishing water conservation mechanisms, strengthening water use management, improving water conservation measures, and strengthening safeguard and supervision, making it the first administrative regulation specifically on water conservation in China.

The “Regulations” delineate with clear stipulation along the entire water use process, covering all aspects of water conservation planning, quota allocation, metering, and water supply, to achieve refined management and efficient utilization of water resources. In particular, through the application of water use quotas, the water use standards and limits are defined in various industries, providing a quantitative basis and target for water conservation.

In addition, the “Regulations” put forward comprehensive water conservation measures from various aspects, including industry, agriculture, and daily life. In the industrial field, it is required that industrial enterprises should strengthen internal water management, establish a water conservation management system, encourage enterprises to adopt advanced water conservation technologies and equipment to realize water recycling and wastewater reuse, and improve the reuse rate of water resources. Heavy-water-consuming industrial enterprises whose water consumption level exceeds the water consumption quota should carry out water-saving rectification within a limited period. It is clearly stated that industrial enterprises should recycle and utilize cooling water, air-conditioning cooling water, and boiler condensate; heavy water-consuming industrial enterprises should gradually adopt technical measures to deepen treatment and reuse wastewater.

生态环境部:关于公开征求《排污许可证申请与核发技术规范 火电(二次征求意见稿)》等四项国家生态环境标准意见的通知

Ministry of Ecology and Environment: Notice on Public Consultation of Four National Ecological Environment Standards Including “Technical Specification for Application and Issuance of Pollutant Permit for Thermal Power (Second Consultation Paper)”

通知发布了火电、钢铁工业、汽车制造业和锅炉四个领域的排污许可证申请与核发技术规范制修订征求意见稿。

现行四个领域的技术规范都在2017~2018年发布实施,在排污许可证申请、核发、执行与监管过程中,发现可进一步优化调整的技术细节与提升制度效能的改进空间,因此按照排污许可制度改革要求,针对四领域排污许可证先期实践经验与生态环境后续管理需要,对《技术规范》进行修改完善,服务环境管理决策。

The notice issued the consultation paper of the revised technical specifications for applying and issuing pollutant discharge permits (PDP) in four fields: thermal power, the iron and steel industry, automobile manufacturing, and boilers.

The current technical specifications in the four fields were released and implemented in 2017 to 2018. In the process of application, issuance, implementation, and supervision of PDP, it is found that the technical details can be further optimized and adjusted to improve system efficiency. Therefore, to align with reform of the PDP system, the “Technical Specifications” are revised and improved based on the early practical experience in the four fields to better meet the needs for environmental management decision making.

北京市:北京市碳排放权交易管理办法

Beijing: Measures of Beijing Municipality on Carbon Emission Trading Administration

办法制定了碳排放单位名单管理、配额管理、碳排放权交易、报告与核查、配额清缴、监督管理等方面的具体规定和操作细则。

办法规定年度二氧化碳排放总量达到5000吨(含)以上的单位为重点碳排放单位;年综合能源消费量2000吨标准煤(含)以上的单位为一般碳排放报告单位。根据本市碳排放总量和强度控制目标,核算年度配额总量,对本市行政区域内重点碳排放单位的二氧化碳排放实行配额管理,履行碳排放控制责任。

The Measures set out specific requirements and operational rules for developing carbon emission unit lists, quota management, the trading of carbon emission rights, reporting and verification, quota clearance, supervision, and management, etc.

The Measures stipulate that units with total annual carbon dioxide emissions of 5,000 tons (inclusive) or more are key carbon emission units; and units with annual comprehensive energy consumption of 2,000 tons of standard coal (inclusive) or more are general carbon emission reporting units. According to the city’s total carbon emissions and intensity control targets, annual quota amount will be calculated, and assigned to the key carbon emission units within the jurisdiction, which then fulfill their obligation of carbon emission quota control.

河南省:关于印发2024年深化企业安全生产双重预防机制建设运行的方案的通知

Henan: Notice on Issuing the Plan for Deepening the Construction and Operation of Double Prevention Mechanism for Safety Production in 2024

方案要求企业遇有重大危险作业、重大隐患、非正常生产重大变化,同行业发生重大事故等情形,要及时开展专题研判。要结合每月“主题安全日”,组织开展做好危险作业“一备三查”和一线从业人员岗位“事故假想”。

方案要求对照《企业安全生产风险管控与隐患治理双重预防机制效能评估规范》(DB41/T2292-2022),督促指导规模以上企业制定评估方案、收集数据、分析评估、撰写报告、整改落实和跟踪评估的内部管理制度,实现风险隐患自查自改常态化并持续改进,年内实现规上企业年度自评全覆盖。

The Plan requires enterprises to carry out timely thematic studies and review in the event of high-risk operations, major hidden dangers, big changes in abnormal operations, and severe accidents in the same industry. Combining with the monthly “theme safety day”, enterprises should organize and carry out “one preparation and three checks” for high risk operations and “accident hypothesis” for front-line employees.

The Plan requirements local safety authority to urge and instruct the enterprises above designated size to develop assessment plans, data collection, analysis and assessment, report writing, rectification and implementation and tracking and evaluation of the internal management system following “Norms for evaluation of the effectiveness of dual prevention mechanisms of enterprise safety production risk management and hidden risk management” (DB41/T2292-2022), to achieve the normalization of the risk and hidden risk self-checking and continuous improvement, and full coverage of annual self-assessment of enterprises above designated size within the year.

上海市:加快提升本市涉外企业环境、社会和治理(ESG)能力三年行动方案(2024-2026年)

Shanghai: Three-Year Action Plan for Accelerating the Enhancement of Environmental, Social, and Governance (ESG) Capabilities of Outbound Enterprises in Shanghai (2024-2026)

近日上海市商务委印发了《加快提升本市涉外企业环境、社会和治理(ESG)能力三年行动方案(2024-2026年)》,是全国首个ESG区域行动方案,以激发涉外企业提升ESG能力。提升涉外企业ESG水平的目的则是支持企业参与全球产业链、供应链、价值链分工合作。方案设定的目标是在2026年基本形成涉外企业ESG生态体系,初步建立企业ESG报告编制及评价标准体系,提升涉外企业ESG能力—“力争具有涉外业务的国有控股上市公司ESG信息披露实现全覆盖,民营上市企业ESG信息披露率明显提高”。

上海三年行动方案中也提到,要“借鉴新加坡、中国香港在ESG能力建设方面的经验”。目前,港交所和新加坡交易所对上市企业ESG的信息披露要求,都已经从鼓励披露、强制披露(不披露就解释),向气候相关信息披露要求过渡。根据上海证券交易所最新的可持续发展信息披露指引,则是要求部分上市公司到2026年强制披露。

The Shanghai Municipal Commission of Commerce recently issued the ” Three-Year Action Plan for Accelerating the Enhancement of Environmental, Social, and Governance (ESG) Capabilities of Outbound Enterprises in Shanghai (2024-2026)”, which is the first regional action plan on ESG to enhance ESG capabilities of outbound enterprises. Enhancing ESG levels of outbound enterprises can facilitate their participation in the global industrial chain, supply chain, and value chain for international division and cooperation. The goal of the plan is to basically form an ESG ecosystem for outbound enterprises, establish a standard system for compiling and evaluating enterprise ESG reports, and enhance the ESG capabilities of outbound enterprises by 2026 – “strive to achieve full ESG information disclosure by state-owned listed companies with outbound businesses, and significantly increase the ESG information disclosure rate of private listed companies”.

Shanghai’s three-year action plan also mentions that it will “learn from experience of Singapore and Hong Kong in ESG capacity building”. At present, both the Hong Kong Stock Exchange and the Singapore Exchange have transitioned from encouraging disclosure and mandatory disclosure (or explaining without disclosure) to climate-related disclosure requirements for ESG disclosure by listed companies. According to the Shanghai Stock Exchange’s latest sustainability disclosure guidelines, some listed companies are required to disclose ESG information by 2026.

上海市:上海市加快建立产品碳足迹管理体系 打造绿色低碳供应链的行动方案

Shanghai: Action Plan for Accelerating the Establishment of a Product Carbon Footprint Management System and Creating a Green and Low-Carbon Supply Chain

根据《国家发展改革委等部门关于加快建立产品碳足迹管理体系的意见》,上海市制定地方方案,计划2025年制定出台30个左右产品碳足迹相关地方、企业或团体标准,基本建成产品碳足迹服务平台体系;到2030年,制定出台100个左右产品碳足迹相关地方、企业或团体标准,全面建成产品碳足迹服务平台体系,推动产品碳标识认证制度在长三角全面实施并广泛应用。

方案鼓励钢铁、化工、飞机、造船、汽车、电子、快消品等领域链主企业开展绿色低碳供应链建设试点示范,并结合实际建立产品碳足迹管理制度,带动上下游企业加强碳足迹管理,推动供应链整体绿色低碳转型。

According to the “Opinions on Accelerating the Establishment of a Product Carbon Footprint Management System” issued by National Development and Reform Commission etc, Shanghai has formulated a local plan to develop and introduce about 30 product carbon footprint- standards in 2025 (either local, company or group standards), basically build a product carbon footprint service platform; by 2030, develop and introduce about 100 product carbon footprint standards, comprehensively build a product carbon footprint service platform, and fully implement and apply product carbon labeling certification system in the Yangtze River Delta region.

The plan encourages supply chain-owning enterprises in the fields of iron and steel, chemical industry, aircraft, shipbuilding, automobile, electronics, and FMCG sectors to carry out pilot demonstrations of green and low-carbon supply chain construction. With establishment of product carbon footprint management system, the pilot program can drive upstream and downstream enterprises to strengthen their carbon footprint management, and promote the overall green and low-carbon transformation of the supply chain.
