关于修改《建设工程消防设计审查验收管理暂行规定》的决定

Decision on Amending the “Interim Provisions on the Administration of Fire Protection Design Review and Acceptance of Construction Projects”

2023年8月21日住房和城乡建设部令第58号公布,决定对《建设工程消防设计审查验收管理暂行规定》(住房和城乡建设部令第51号)作出修改。此次修改作出了八条调整,主要内容涉及了特殊消防设计、专家评审会、其他建设工程分类管理、告知承诺制等内容。主要变动涉及以下两个方面:

一是特殊消防设计范围增加、程序简化、技术要求加强。修改后的《规定》对需要提交特殊消防设计技术资料的建设工程范围进行了调整,同时进一步加强对特殊消防设计的技术要求。

二是改进其他建筑工程的分类管理及备案抽查制度,对除特殊建设工程以外的其他建设工程进行分类管理。依据建筑所在区域环境、建筑使用功能、建筑规模和高度、建筑耐火等级、疏散能力、消防设施设备配置水平等因素分为一般项目、重点项目等两类。由各省、自治区、直辖市人民政府住房和城乡建设主管部门制定其他建设工程分类管理目录清单。属于一般项目的其他建设工程验收备案可以采用告知承诺制的方式申请备案,消防设计审查验收主管部门依据承诺书出具备案凭证,重点项目将作为竣工验收备案抽查重点。采用告知承诺制一方面进一步简化了备案程序,另一方面强调了企业应承担的主体责任。

The Ministry of Housing and Urban-Rural Development published Order No. 58 on August 21, 2023, deciding to make amendments to the “Interim Provisions on the Administration of Review and Acceptance of Fire Protection Designs for Construction Projects” (Ministry of Housing and Urban-Rural Development Order No. 51). Eight adjustments have been made to this revision. The main content includes special fire protection design, expert panel review meeting, other construction project classification management, notification and commitment system. The main changes are made in the following two aspects:

Firstly, the scope of special fire protection design has been extended, while the procedure has been simplified and the technical requirements have been strengthened. The revised Provisions have adjusted the scope of construction projects required to submit technical documents for special fire protection design, and further strengthened the technical requirements for special fire protection design.

Secondly, it improves the classification management as well as filing and random inspection system for other construction projects. Construction projects other than special construction projects are managed by classification defined. Other construction projects are divided into general projects and key projects in accordance with the factors of general environment, building function, building size and height, fire resistance level, evacuation capacity, fire protection facilities and equipment etc. Category of other construction projects shall be developed by the provincial housing and urban-rural construction departments. Acceptance filing of general projects is subjected to notification and commitment system. Filing receipt will be issued according to the commitment letter. Spot check will be conducted for key projects. The establishment of notification and commitment system further simplifies the filing process, and in the meantime, emphasizes the main responsibility of enterprises.

生态环境部:关于发布《有毒有害水污染物名录(第二批)》的公告(征求意见稿)

Ministry of Ecology and Environment: Announcement on Publishing the “Catalogue of Toxic and Harmful Water Pollutants (Second Batch)” (Draft for Consultation)

第二批名录拟收录11种(类)物质,其中有机物9种(类),重金属及无机化合物2类,包括铊及铊化合物、总氰化物、五氯酚及五氯酚钠、苯、甲苯、硝基苯类、苯胺类、1,1-二氯乙烯、六氯丁二烯、多环芳烃类、二噁英类等。

The second batch of the Catalogue proposes to include 11 substances, including 9 organic substances and 2 heavy metals and inorganic compounds. The catalogue includes thallium and thallium compounds, total cyanide, pentachlorophenol and sodium pentachlorophenol, benzene, toluene, nitrobenzene, aniline, 1,1-dichloroethene, hexachlorobutadiene, polycyclic aromatic hydrocarbons (PAHs), and dioxins.

生态环境部:关于公开征求《石油炼制工业污染物排放标准》等3项国家标准修改单(征求意见稿)意见的通知

Ministry of Ecology and Environment: Notice on Publicly Soliciting Opinions on the 3 Revision Sheet of National Standards (Draft for Consultation) Including “Emission Standard of Pollutants for Petroleum Refining Industry”

此次对《石油炼制工业污染物排放标准》(GB 31570—2015)、《石油化学工业污染物排放标准》(GB 31571—2015)和《合成树脂工业污染物排放标准》(GB 31572—2015)三项标准的修改主要集中在VOC排放控制方面。其中《合成树脂工业污染物排放标准》(征求意见稿)明确将塑料制品生产划分到合成树脂(化工行业)之外,不再适用本标准,可参照执行。

The modifications of the three standards, i.e. Emission Standard of Pollutants for Petroleum Refining Industry (GB 31570-2015), Emission Standard of Pollutants for Petroleum Chemistry Industry (GB 31571-2015) and Emission Standard of Pollutants for Synthetic Resin Industry (GB 31572-2015), mainly focus on VOC emission control. Among them, the Emission Standard of Pollutants for Synthetic Resin Industry explicitly categorizes the production of plastic products outside of the synthetic resin (chemical industry), which is no longer subject to this standard and the standard can be executed as reference.

生态环境部:关于继续开展小微企业危险废物收集试点工作的通知(征求意见稿)

Ministry of Ecology and Environment: Notice on Continuing the Pilot Program of Hazardous Waste Collection in Small and Micro Enterprises (Draft for Consultation)

为推动进一步完善小微企业危险废物收集体系,通知(征求意见稿)决定继续开展小微企业危险废物收集试点工作,试点要求与《关于开展小微企业危险废物收集试点的通知》(环办固体函[2022]66 号)一致,试点时间延长至 2025年 12 月 31 日。

通知(征求意见稿)要求各级生态环境部门应强化对小微企业危险废物收集试点单位的环境监督管理,将其纳入危险废物环境重点监管单位,并作为危险废物规范化环境管理评估重点。

In order to promote further improvement of the hazardous waste collection system for small and micro enterprises, the Draft decides to continue carrying out the pilot program of hazardous waste collection in small and micro enterprises, with the pilot requirements consistent with the 2022 Notice (Huan Ban Gu Ti Han [2022] No. 66), and the pilot period is extended to December 31, 2025.

The Draft requires that departments of ecology and environment at all levels should strengthen the environmental supervision and management of the pilot hazardous waste collection entities of small and micro enterprises, and include them in the key environmental supervision entities of hazardous wastes and make them the focus of the assessment of standardized environmental management of hazardous wastes.

生态环境部:关于开展废铅蓄电池跨省转移审批“白名单”试点工作的通知(征求意见稿)

Ministry of Ecology and Environment: Notice on the Pilot Work of the “White List” for the Approval of Cross-provincial Transfer of Waste Lead Storage Batteries (Draft for Consultation)

为推动废铅蓄电池跨省转移便捷化,切实减轻废铅蓄电池收集利用企业负担, 征求意见稿提出在全国范围,选择部分再生铅企业和废铅蓄电池收集单位建立废铅蓄电池跨省转移审批“白名单”。

试点期间,“白名单”中的移出单位向“白名单”中的接受单位跨省转移废铅蓄电池的,按照省内危险废物转移管理,无需危险废物跨省转移审批;“白名单”外的其他单位向“白名单”中的接受单位跨省转移废铅蓄电池的,移出地省级生态环境部门无需再商经接受地省级生态环境部门同意,可以直接作出危险废物跨省转移审批决定。

试点工作自本通知正式发布之日起,至 2025 年 12 月 31 日结束。

In order to promote the convenience of cross-provincial transfer of waste lead storage batteries, and effectively reduce the burden on enterprises in collecting and utilizing waste lead storage batteries, the Draft proposes to establish a “white list” for the approval of cross-provincial transfer of waste lead storage batteries on a nationwide basis by selecting recycle and collection entities.

During the pilot period, no approval for cross-provincial transfer is needed for the transfer between the transfer entities and acceptance entities listed in the “white list” ; Transfer entities outside of the “white list” shall only apply for approval at local provincial department of ecology and environment when transferring to acceptance entities listed in the “white list” .

The pilot project will start from the date of the official release of this notice and end on December 31, 2025.

北京市:北京市单位消防安全主体责任规定

Beijing: Provisions of Beijing Municipality on Main Responsibility for Fire Safety of an Entity

本规定自2023年9月1日起施行。2004年3月18日北京市人民政府第143号令公布的《北京市消防安全责任监督管理办法》同时废止。规定聚焦火灾的预防和控制,构建了单位消防安全主体责任体系。规定了单位内部涵盖主要负责人、分管负责人、消防安全管理人员以及逐级逐岗的全员消防安全责任体系;细化了包含单位的主体责任、单位全员的消防安全责任、单位日常的消防安全管理责任、单位的消防宣传教育和培训责任等在内的各方具体责任要求。明确了各类社会单位“一把手”的消防安全第一责任。

The Provisions shall come into force on September 1, 2023, and the “Management Measures of the Beijing Municipality on the Supervision of Fire Safety Responsibilities” (Order No. 143) shall be repealed at the same time. The Provisions focus on fire prevention and control, and establishes the full types responsibility system for business entity. The Provisions stipulates responsibility system by levels and positions, including main person in charge, sub-main person in charge and fire safety management personnel; refines the specific fire safety responsibility at different aspect including the main responsibility of the entity, the fire safety responsibility of all staff, the daily fire safety management responsibility, the education, and training responsibility, etc. The Provisions also clarifies the first responsibility for fire safety of the top management of various social entities.

天津市:天津市危险化学品企业安全治理规定

Tianjin: Provisions on the Safety Management of the Enterprises of Hazardous Chemicals in Tianjin Municipality

天津市出台《天津市危险化学品企业安全治理规定》作为本市危险化学品管理的综合指导。在梳理了国家和本市有关危险化学品管理法律法规和标准,以政府规章形式,对治理对象、治理原则和目标、企业主体责任、政府属地责任、部门监管责任、综合治理措施、第三方参与治理、法律责任等做出了明确规定。

规定在现有要求的基础上,细化企业安全生产主体责任和相关从业人员履职及专业素质能力要求,明确企业应履行安全生产保障职责并开展季度自查。

规定特别强调了危险化学品企业对重大危险源、危险源点要加强监控,保证24小时监控系统正常运行,并实时、如实、准确、客观地将有关安全的监测及业务数据与负有危险化学品安全监督管理职责的部门连接;以及应建立并执行安全生产设施设备检修报废等制度。

Tianjin Municipality has issued the “Provisions on the Safety Management of the Enterprises of Hazardous Chemicals in Tianjin Municipality” as a comprehensive guidance for the management of hazardous chemicals within the jurisdiction of the city. After completing comprehensive investigation and research on relative national and municipal laws, regulations, and standards, the Provisions were issued to include requirements on governance objects, principles, targets, the main responsibility of enterprises, the responsibility of local government, supervisory responsibility of the departments, comprehensive measures, participation of third parties, and legal liabilities.

On the basis of the existing requirements, the Provisions refine the requirements for the main responsibility for production safety of enterprises and the performance of duties and professional qualities and abilities of relevant practitioners, and clarifies that enterprises should fulfill their responsibilities on production safety and carry out quarterly self-inspections.

In particular, the Provisions emphasize that enterprises handling hazardous chemical should strengthen the monitoring of major sources and points of danger, ensure the normal operation of 24-hour monitoring system, and real-time, truthful, accurate and objective connection of all data on safety management of hazardous chemical with the departments responsible for supervision; establish and implement a system for overhauling and scrapping safety production facilities and equipment.
