自2020年10月中共中央、国务院印发《黄河流域生态保护和高质量发展规划纲要》要求深入开展黄河立法工作,《中华人民共和国黄河保护法》历经三审,于2022年10月30日通过。
《黄河保护法》包括总则、规划与管控、生态保护与修复、水资源节约集约利用、水沙调控与防洪安全、污染防治、促进高质量发展等11章,共122条。
《黄河保护法》明确了职责分工,国务院水行政主管部门黄河水利委员会(黄河流域管理机构)及其所属管理机构,依法行使流域水行政监督管理职责;国务院生态环境主管部门黄河流域生态环境监督管理机构依法开展流域生态环境监督管理相关工作。黄河流域县级以上地方人民政府负责本行政区域黄河流域生态保护和高质量发展工作。
针对水资源短缺问题,《黄河保护法》规定了水资源强制性约束控制指标、水资源统一调度、地下水取用水总量和水位控制、取水许可限批、用水定额、行业节水等制度措施;针对黄河流域污染严重的突出问题,规定了黄河流域水环境质量标准、水污染物排放标准、流域重点污染物排放总量控制、排污口监管、土壤和地下水污染防治、农业面源污染防治等制度措施。
同时,《黄河保护法》禁止在黄河干支流岸线管控范围内新建、扩建化工园区和化工项目。
The Central Committee of the Communist Party of China and the State Council issued the “Outline of the Plan for Ecological Protection and High-quality Development in the Yellow River Basin” in October 2020, which to required initiating legislation for the Yellow River Basin. The final “Yellow River Protection Law of the People’s Republic of China” (the “Law”) was published on October 30, 2022 after three rounds of trials.
The “Law” has overall 11 chapters, including General Provisions, Planning and Control, Ecological Protection and Restoration, Conservation and Intensive Utilization of Water Resources, Water and Sediment Control and Flood Control Safety, Pollution Prevention and Control, Promoting High-Quality Development etc., with a total of 122 Articles.
The “Law” defines the responsibilities that the Yellow River Water Conservancy Commission under the Water Administrative Department of the State Council (the Yellow River Basin Management Agency) and its subordinate management agencies are responsible for water administrative supervision and management in accordance with the Law; the Ecological and Environment Supervision and Administration Agency of the Yellow River Basin under Ministry of Ecological and Environment is responsible for ecological and environmental supervision and management of the Yellow River Basin in accordance with the law. The local people’s governments at or above the county level in the Yellow River Basin are responsible for the ecological protection and high-quality development of the Yellow River Basin within their respective jurisdictions.
In response to the shortage of water resources, the “Law” stipulates institutional measures including applying the mandatory restriction and control quota of water resources, the unified dispatch of water resources, the control of the total amount of water abstraction and groundwater level control, restrict water abstraction approval, water consumption quota control, and the industrial water conservation etc. To address the serious pollution in the Yellow River Basin, the Law stipulates institutional measures including setup specific water environment quality standards, water pollutant discharge standards, and total discharge control of key pollutants in the basin, as well as the monitoring of sewage outlets, the prevention and control of soil and groundwater pollution, and the prevention and control of agricultural non-point source pollution.
At the same time, the “Law” clearly prohibits the construction and expansion of chemical industrial parks and chemical projects within the management and control scope of the main and tributaries of the Yellow River.
最新国家法律法规 New Regulations
2022年初,国家卫生健康委实施《国家职业病防治规划(2021-2025年)》,明确要求推进职业卫生分类监督执法工作。为此,通知要求于2022年11月1日在全国开展为期2年的试点工作。
通知要求各省份根据辖区职业病防治重点行业、重点地区、重点职业病危害以及职业病防治工作实际情况确定试点地区。用人单位根据职业病危害风险分级(Ⅰ级、Ⅱ级、Ⅲ级)和职业卫生管理状况分级结果(A、B、C三级)综合评估得出其职业病危害综合风险等级,分为甲乙丙三级。
用人单位完成《用人单位职业病危害综合风险评估报告》应将结果进行公示。并在10个工作日内报送属地监督执法行政部门或监督机构存档备查。用人单位职业病危害综合风险评估每三年开展一次。期间发生重大变化应重新进行评估。新建的用人单位应在正式投产2个月内完成评估。
监督执法行政部门和监督机构将以风险类别为基础开展差异化随机抽查工作,提高执法效能。
At the beginning of 2022, the National Health Commission implemented the “National Occupational Disease Prevention and Control Plan (2021-2025)”, which clearly requires promoting classified supervision and enforcement on occupational health work. To this end, the Notice calls for a 2-year pilot work across the country starting from November 1, 2022.The Notice requires provinces to determine pilot areas based on key industries, key areas, key occupational disease hazards, and their actual situation of occupational disease prevention and control in their jurisdictions.
Enterprise shall determine its comprehensive risk level of occupational disease hazards that are rated as three levels, according to the occupational disease hazard risk (level I, II, and III) and level of management status (level A, B, and C).
The enterprise shall publicize the results when they complete the “Comprehensive Risk Assessment Report on Occupational Disease Hazards, and submit the report to the competent administrative department or supervisory agency for archival filing within 10 working days. The comprehensive risk assessment of occupational disease hazards should be carried out every three years. Any significant changes in the period will trigger a re-assessment. The newly-built enterprises shall complete the assessment within 2 months after the formal production.
Supervision and enforcement administrative departments and supervisory agencies will carry out differentiated random inspections based on risk categories to improve enforcement efficiency.
工业和信息化部:关于开展2022年工业废水循环利用试点工作的通知
通知要求各地组织开展2022年工业废水循环利用试点工作,重点用水行业工业企业可以申报。鼓励废水循环利用技术、工艺和装备供应商与应用企业联合申报。各地方申报企业数量原则上不超过3个、申报园区数量不超过1个。
试点方向主要为用水过程循环模式、区域产城融合模式、智慧用水管控模式、废水循环利用补短板模式及其他经验做法。
试点期限为1年。
The Notice requires all provinces to organize the pilot project of recycling industrial wastewater in 2022.Industrial enterprises in key water industries can apply and participate the pilot project. The Notice encourages joint application of wastewater recycling technology and equipment suppliers together with application companies. In principle, the number of applying enterprises in each locality shall not exceed 3, and the number of parks shall not exceed 1.
The pilot practices mainly include the water use circulation model, the regional industry-city integration model, the smart water management and control model, the waste water recycling model and other experience and practices.
The pilot period is 1 year.

最新地方性法规 Regional Updates
2017版《上海市固定资产投资项目节能审查实施办法》有效期5年,于2022年10月31日到期。本次重新发布是为了延续2017版的实施要求,基本内容没有变化。即要求年综合能源消费量(增量)1000吨标准煤以上(含),或年电力消费量(增量)500万千瓦时以上的项目,应单独进行节能审查,其他企业不单独进行节能审查。
新版自2022年11月1日起施行,有效期至2025年10月31日。
The 2017 edition of “Measures for the Implementation of Energy Conservation Review of Fixed Asset Investment Projects in Shanghai” is valid for 5 years and will expire on October 31, 2022. The release of the new version is to continue the implementation requirements of the 2017 edition, without significant changes in basic content. Namely, projects that has an annual energy consumption (increment) of 1,000 tons of standard coal or more, or projects that has an annual power consumption (incremental) of 5 million kWh or more, should undergo a separate energy conservation review. Other enterprises are not obliged to conduct a separate energy conservation review.
The new edition will be implemented from November 1, 2022, and will be valid until October 31, 2025.

Consolidate practical experience in the small and minor quantity hazardous waste collection and transportation systems, promote the professional collection and storage facilities for small and minor quantity hazardous waste generators, and clarify the management requirements for epidemic-related waste during pandemic outbreaks.
In addition to electrical appliances, lead storage batteries, and automotive power batteries, the extended producer responsibility system also incorporates the manufacturers of paper-based beverage composite packaging.
The Regulations also clearly stipulates that hazardous waste generators store hazardous wastes no more than one year; if it is really necessary to extend the period, the generators should update the hazardous waste management plan via the provincial solid waste management system within 30 days before the deadline, and clarify the extended period and reasons. The extension period shall not exceed one year.
