Ministry of Ecology and Environment: Environmental Impact Assessment and Pollution Permit System Implementation Plan during “14th Five-Year Plan
“十三五”期间,环评“放管服”力度空前,取消了竣工环保验收和环评机构资质审批等多项行政许可,登记表由审批改为在线备案,环评进一步聚焦重点、优化流程、提高效能。“十四五”期间,方案明确将持续环评制度深化改革,实现全链条优化管理,即健全完善涵盖生态环境分区管控、规划环评、项目环评、排污许可的管理制度体系,明确功能定位、责任边界和衔接关系,避免重复评价,并探索温室气体排放环境影响评价。
根据方案,“十四五”时期排污许可工作将进一步巩固、深化“全覆盖”“全联动”,推动“一证式”监管。加强与环评联动,开展管理对象、内容和机制的衔接。开展与总量、环统等制度联动,将污染物排放量削减要求纳入排污许可证,推动将执行报告中的排放量作为环统的主要来源。
同时构建以排污许可制为核心的固定污染源执法监管体系,作为日常执法监管的主要依据。
During the “13th Five-Year Plan” period, EIA’s reforms has been launched to fulfill “delegate power, streamline administration and optimize government services”. A number of administrative permitting processes were cancelled, including environmental protection completion acceptance approval and EIA consulting firm qualification system. The registration form was changed from approval to online filing. EIA system focused on key industries, optimizing processes, and improving efficacy. During the “14th Five-Year Plan” period, the Implementation Plan clearly stipulates to deepen the reform of the EIA system and optimize project life cycle environmental management, to streamline environmental permitting system from environment zoning control, planning EIA, project EIA, to pollutant discharge permit (PDP) system, and clearly defines their functional positioning, responsibility and relationships to avoid duplicated assessment. In addition, carbon assessment will be integrated into EIA system gradually after the pilot program.
According to the plan, during the “14th Five-Year Plan” period, PDP system will be consolidated and expanded to fully cover pollution sources and fully link with EIA system to promote “one permit” supervision. PDP system will be further integrated with EIA system in terms of management objects, contents and mechanisms, as well as to link with mass loading quota system and environmental statistics system. Pollutant discharge reduction requirements will be included in PDP, with PDP implementation report being main data inputs for environmental statistics.
At the same time, the Implementation Plan aims to establish a stationary pollution source enforcement and supervision system with PDP as a core element and the main basis for daily enforcement and supervision.

Work Safety Committee of the State Council: National work safety Plan during the “14th Five-Year” Period
国务院安全生产委员会日前发布“十四五”国家安全生产规划,提出到2025年安全生产形势趋稳向好、到2035年基本实现安全生产治理体系和治理能力现代化的奋斗目标,以及“十四五”时期要实现的6项具体指标。
按照国家“十四五”专项规划编制工作的统一部署和应急管理领域“1+2+N”规划体系布局(“1”即《“十四五”国家应急体系规划》,为“十四五”时期应急管理领域最上位规划;“2”个安全生产、综合防灾减灾规划,以及N个消防、矿山安全、防震减灾、装备发展、应急力量建设等规划),做好十四五安全生产和应急工作。
规划提出了织密风险防控责任网络、优化安全生产法治秩序、筑牢安全风险防控屏障、防范遏制重特大事故、强化应急救援处置效能、统筹安全生产支撑保障、构建社会共治安全格局7个方面的主要任务,凝练了重大安全风险治理工程、监管执法能力建设工程、安全风险监测预警工程、救援处置能力建设工程、科技创新能力建设工程、安全生产教育实训工程6类重大工程。
为了确保规划的落实,规划从明确任务分工、加大政策支持、推进试点示范、强化监督评估等4个方面提出了建立健全规划实施保障的机制与举措。
Work Safety Committee of the State Council recently issued the “14th Five-Year Plan” for national work safety work, which sets the long term goals, i.e. stabilizing and improving the work safety situation by 2025, and basically realizing the modernization of the work safety governance system and governance capacity by 2035, and defines the 6 specific indicators to be achieved during the “14th Five-Year Plan” period.
According to the deployment of the national “14th Five-Year special planning work and the “1+2+N” planning layout for emergency management, (“1” represents the “The Plan for National Emergency Response System During the “14th Five-Year Plan”Period” , which is the top plan in emergency management; “2” represents 2 plans including a work safety plan and a comprehensive disaster prevention and mitigation plan; and N represents numerous plans on different aspects, e.g. fire protection, mining safety, earthquake prevention and disaster mitigation, equipment development, and emergency force capacity building), this Plan is developed for work safety and emergency management work during the “14th Five-Year Plan”Period”.
The plan puts forward 7 major tasks, including tighten the network of responsibility for risk prevention and control, optimize the rule and order in production safety, build a strong safety risk prevention and control barrier, prevent and curb the occurrence of major accidents, strengthen the effectiveness of emergency rescue and disposal, coordinate production safety support and build a social co-governance security pattern, supported by 6 major projects, comprising major safety risk governance projects, supervision and enforcement capacity building projects, risk monitoring and early warning projects, rescue and disposal capacity building projects, scientific and technological innovation capacity building projects, and work safety education and training projects.
The Plan proposes the mechanism and safeguard measures for the implementation of the plan in four aspects: clarifying the task breakdown, reinforcing the policy support, promoting pilot and demonstrations, and strengthening supervision and evaluation.
Ministry of Ecology and Environment: Guidelines on Strengthening the Enforcement and Supervision of Pollutant Discharge Permits (PDP)
意见提出到2023年年底,重点行业实施排污许可清单式执法检查。到2025年年底,排污许可清单式执法检查全覆盖,以排污许可制为核心的固定污染源执法监管体系全面建立。
清单式执法检查是以排污许可证载明事项为重点的执法检查,重点检查排放口规范化建设、污染物排放浓度和排放量、污染防治设施运行和维护、无组织排放控制等要求的落实情况,抽查核实环境管理台账记录、排污许可证执行报告、自行监测数据、信息公开内容的真实性。
排污许可执法监管纳入年度现场检查计划。建立健全非现场执法监管机制,推行远程核查,视频监控等。
The Guidelines proposes that by the end of 2023, checklist-based PDP enforcement inspections will be applied to the key industries. By the end of 2025, the checklist-based enforcement and inspection will be applied to all industries, and enforcement and supervision system on stationary pollution sources shall be fully established with PDP system as core.
Checklist-based enforcement inspections focus on the itemized requirements in the PDP, emphasizing the implementation of the requirements in PDP, e.g. standardized construction of discharge outlets, pollutant discharge concentration and quantity, operation and maintenance of pollution prevention and control facilities, and fugitive emission control; also checking and verifying the authenticity of environmental recordkeeping, PDP implementation reports, self-monitoring data, and information disclosure content.
The PDP enforcement and supervision will be incorporated into the annual on-site inspection plan. The Guidelines also proposes to establish and improve off-site enforcement and supervision mechanisms and promote remote verification and video surveillance.

Emergency Management Department: General Rules for Designing the Production Facilities in Accordance With Safety Guard Requirements (Consultation Paper)
国家标准《生产设备安全卫生设计总则》(GB 5083-1985)于 1985年首次发布,1999 年完成第一次修订,本次修订为第二次修订。
本次修订删除了原标准中职业卫生的相关内容,但保留了急性中毒相关内容;增加了环保设施安全防护相关内容;增加了智能化、远程控制等相关内容;增加了基于风险评估的生产设备故障失效分析的内容。
The national standard “General Rules for Designing the Production Facilities in Accordance With Safety and Health Requirements” (GB 5083-1985) was first published in 1985, first revised in 1999, and this is second revision.
This revision deletes the content related to occupational health, but retains the content related to acute poisoning; it adds the content related to the work safety of environmental protection facilities, as well as intellectualization, remote control, and failure analysis of production equipment based on risk assessment.

Guangdong Province: Notice on Issuing the Environmental Emergency Response Plans (ERP) in Guangdong Province
2022版预案是对2017版预案(粤府函[2017]280号)的修订。预案适用于广东省行政区域内突发环境事件应对工作。
本次修订完善一是反应了机构改革后突发环境事件应急指挥体系和相关部门承担的应急职责的变化;二是对应新发布的《广东省突发事件总体应急预案》(粤府函[2021]109号)。将省级层面突发环境事件应急响应从高到低分为一级、二级、三级、四级四个等级,明确了各级应急响应的启动程序、实施主体和主要措施,同时进一步完善提级应对的机制。
The new ERP is revised based on 2017 version, which is applicable to the environmental emergencies response within the administrative region of Guangdong Province.
The revision reflects the changes in the environmental emergency command system and the emergency responsibilities undertaken by relevant departments after the institutional reform; secondly, it corresponds to the newly released “Overall Emergency Response Plan in Guangdong Province”(Yue Fu Han [2021] 109). The environmental emergency response at the provincial level is divided into four levels from high to low, with the corresponding activation procedures, implementation subjects and main measures of emergency response at different levels while the mechanism for escalation response has been further improved.
Jiangsu Province: The Regulations of Jiangsu Province on Soil Pollution Prevention and Control
继《江苏省大气污染防治条例》《江苏省水污染防治条例》之后,江苏省又制定出台了《江苏省土壤污染防治条例》,形成了大气、水、土壤三位一体的污染防治地方性法规制度体系。条例要求大气污染防治、水污染防治、固体废物污染防治应当与土壤污染防治统筹部署,推动一体防治,实现源头预防;并具体作了六个方面的规定:
一、强化土壤污染重点监管单位管理。
二、强化农业投入品源头预防措施。
三、加强工地塑料防尘网使用及回收监管。
四、强化关闭搬迁化工企业拆除活动监管
五、鼓励企业主动开展调查、留存土样。
六、防止风险管控、修复活动造成二次污染。
Following the “Air Pollution Prevention and Control Regulation” and the “Water Pollution Prevention and Control Regulation”, Jiangsu Province has formulated the “Soil Pollution Prevention and Control Regulation”, forming legislation framework for the prevention and control of air, water and soil pollution. The Regulations requires that the prevention and control of air pollution, water pollution, and solid waste pollution should be coordinated with soil pollution prevention and control to promote integrated prevention and control to achieve source prevention. The Regulations specifically stipulates the following aspects:
1. Strengthen the management of key soil pollution entities subject to supervision.
2. Strengthen preventive measures at the source of agricultural inputs.
3. Strengthen the supervision on the use and recycling of plastic dustproof nets on construction sites.
4. Strengthen the supervision of the demolition activities of closed, relocated chemical facilities.
5. Encourage enterprises to proactively conduct investigations and retain soil samples.
6. Prevent secondary pollution caused by contamination remedation activities.
Zhejiang Province: Implementation Plan for the Reform of the Environmental Information Disclosure System in Zhejiang Province
方案根据国家《环境信息依法披露制度改革方案》《企业环境信息依法披露管理办法》等有关文件要求,结合浙江省实际而制定。
方案提出到2022年,浙江省企业环境信息依法披露系统基本建成,实现省市贯通;到2023年,企业环境信息依法披露有序开展,按国家要求开展环境信息依法披露制度改革评估;到2025年,环境信息依法披露制度基本形成,企业依法按时、如实披露环境信息,多方协作共管机制有效运行,监督处罚措施严格执行,技术规范体系支撑有力,环境披露信息充分应用,社会公众参与度明显上升。
The Implementation plan is formulated in accordance with the national “Plan for the Reform of Environmental Information Disclosure System (EID)”, and the “Measures for the Administration of Environmental Information Disclosure by Enterprises”, taking the actual situation of Zhejiang Province into consideration.
The plan proposes that by 2022, the EID system in Zhejiang Province will be basically established, and networked with cities; By 2023, the EID system reform will be progressed and evaluated in accordance with national requirements; By 2025, EID system will be basically in place, where enterprises are able to disclose environmental information on time and truthfully, where a multi-party collaboration and co-management mechanism will operate effectively, with strict supervision and penalty implied, and supported with strong technical specification system to significantly increase the public participation.
