最高人民法院关于适用《中华人民共和国生态环境法典》时间效力的若干规定

Provisions of the Supreme People’s Court on the Temporal Application of the “Ecological and Environmental Code of the People’s Republic of China”

2026年8月6日,最高人民法院公布《关于适用〈中华人民共和国生态环境法典〉时间效力的若干规定》,作为《中华人民共和国生态环境法典》的首个配套司法解释,该《规定》将于2026年8月15日与法典同步施行。文件旨在解决新旧法律衔接适用问题,为人民法院审理生态环境案件提供裁判指引。

规定明确,以引起生态环境案件的法律事实发生的时间为准。法律事实发生在法典施行(2026年8月15日)之前的,适用当时的法律、司法解释;发生在之后的,适用生态环境法典。针对生态环境损害隐蔽性、累积性、滞后性的特点,规定对跨法典施行前后的持续性行为提供了判断规则,并明确了诉讼程序规则和从轻减轻处罚的适用情形。

On August 6, 2026, the Supreme People’s Court issued the “Several Provisions on the Temporal Effect of the Ecological and Environmental Code of the People’s Republic of China.” As the first supporting judicial interpretation of the Ecological and Environmental Code of the People’s Republic of China, these Provisions will take effect simultaneously with the Code on August 15, 2026. The document aims to resolve issues regarding the transition and application of old and new laws and to provide guidance for courts in judging ecological and environmental cases.

The Provisions clarify that the timing of the legal facts giving rise to an ecological and environmental case shall be the determining factor. If legal facts occurred before the Code took effect (August 15, 2026), the laws and judicial interpretations in force at that time shall apply; if they occurred after August 15, 2026, the Ecological and Environmental Code shall apply. Addressing the characteristics of ecological and environmental damage—namely, its hidden nature, cumulative effects, and time lag—the Provisions provide rules for assessing continuous conduct spanning the period before and after the Code’s implementation, and clarify procedural rules as well as the circumstances under which lighter or reduced penalties may be applied.

“15th Five-Year Plan” for Ecological Conservation Released

2026年8月6日,生态环境部会同自然资源部、住房城乡建设部、水利部、农业农村部、国家林草局联合印发《生态保护“十五五”规划》。作为“十五五”时期全国生态保护工作的顶层专项规划,衔接国家“十五五”规划纲要、《美丽中国建设“十五五”规划》以及《中华人民共和国生态环境法典》相关要求。

规划以提升生态系统多样性稳定性持续性为核心目标,推进山水林田湖草沙一体化保护和系统治理,提出到2030年生态空间格局持续优化、生态质量稳步改善、生物多样性丧失趋势得到有效缓解。

规划对涉及生态敏感区域的企业将产生直接影响:涉及生态保护红线、自然保护地等区域的项目合规门槛进一步提高,生态破坏行为的发现效率和追责力度将显著提升;企业生态修复投入可通过碳汇交易、生态补偿等机制转化为资产收益;生态修复工程、生态监测数智化、生物多样性保护等相关领域的市场需求将进一步释放。

On August 6 2026, the Ministry of Ecology and Environment, in conjunction with the Ministry of Natural Resources, the Ministry of Housing and Urban-Rural Development, the Ministry of Water Resources, the Ministry of Agriculture and Rural Affairs, and the National Forestry and Grassland Administration, jointly issued the “15th Five-Year Plan for Ecological Conservation.” As the principal national plan for ecological conservation during the “15th Five-Year Plan” period, it aligns with the requirements of the National “15th Five-Year Plan” Outline, the “15th Five-Year Plan for Building a Beautiful China,” and the relevant provisions of the “Ecological and Environmental Code of the People’s Republic of China.”

With the enhancement of ecosystem diversity, stability, and sustainability as its core objective, the plan promotes the integrated protection and systematic management of mountains, waters, forests, farmland, lakes, grasslands, and deserts. It sets the goal that by 2030, the ecological spatial pattern will be continuously optimized, ecological quality will steadily improve, and the trend of biodiversity loss will be effectively mitigated.

The plan will have a direct impact on enterprises operating in ecologically sensitive areas: compliance requirements for projects involving ecological conservation red lines, nature reserves, and other such areas will become more stringent, while the efficiency of detecting ecological damage and the severity of accountability measures will be significantly enhanced; enterprises’ investments in ecological restoration can be converted into asset returns through mechanisms such as carbon credit trading and ecological compensation; and market demand in related fields—including ecological restoration projects, intelligent and digital ecological monitoring, and biodiversity conservation—will be further stimulated.

关于进一步加强工业等污水污染风险防范 保障农业灌溉用水安全的通知

Notice on Further Strengthening the Prevention of Pollution Risks from Industrial and Other Wastewater to Ensure the Safety of Agricultural Irrigation Water

通知针对工业企业及园区、畜禽养殖场空间布局不够合理、污水排放管控要求不够完善、农业灌溉用水水质保障机制不够健全等突出问题,围绕空间布局、排放管控、排查整治、监测预警、执法司法五个方面提出核心要求:

  • 禁止向农田灌溉渠道排放工业废水。向农田灌溉渠道排放农产品加工废水的,须保证下游最近灌溉取水点水质符合农田灌溉水质标准;
  • 建设项目环评须衔接农田灌溉水质标准,充分考虑全盐量、重金属、有毒有害污染物等特征污染物对农业灌溉用水的影响,排放管控要求依法载入排污许可证;
  • 2026年年底前完成农田周边工业企业及园区、畜禽养殖企业污水排放排查整治方案制定;
  • 工业园区周边灌溉用水灌溉期至少开展2次监测(临播种前、作物生长关键期),备用或长期未使用的灌溉渠道投入使用前须达标;
  • 重点整治利用溶洞、渗坑、裂隙等非法排放行为,做实行政执法与刑事司法衔接,强化生态环境损害赔偿与检察公益诉讼协同。
    Addressing prominent issues such as the irrational spatial layout of industrial enterprises, industrial parks, and livestock and poultry farms; inadequate wastewater discharge control requirements; and insufficient mechanisms for ensuring the water quality of agricultural irrigation water, the notice sets forth core requirements in five areas: spatial layout, discharge control, investigation and rectification, monitoring and early warning, and law enforcement and judicial proceedings:
  • The discharge of industrial wastewater into farmland irrigation channels is prohibited. Where wastewater from agricultural product processing is discharged into farmland irrigation channels, it must be ensured that the water quality at the nearest downstream irrigation intake point complies with farmland irrigation water quality standards;
  • Environmental impact assessments for construction projects must align with agricultural irrigation water quality standards and fully consider the impact of typical pollutants—such as total dissolved solids, heavy metals, and toxic and harmful pollutants—on agricultural irrigation water. Discharge control requirements must be incorporated into pollutant discharge permits in accordance with the law;
  • By the end of 2026, complete the formulation of investigation and remediation plans for wastewater discharges from industrial enterprises and parks, as well as livestock and poultry farming enterprises, located near farmland;
  • Conduct at least two monitoring sessions during the irrigation season for irrigation water around industrial parks (immediately before sowing and during critical crop growth periods); irrigation channels that are on standby or have been unused for a long time must meet standards before being put into use;
  • Prioritize the rectification of illegal discharges into caves, seepage pits, fissures, and other such locations; ensure effective coordination between administrative law enforcement and criminal justice; and strengthen coordination between ecological damage compensation mechanisms and procuratorial public interest litigation

排污单位自行监测管理办法(征求意见稿)

Measures for the Administration of Self-Monitoring by Pollution Dischargers (Consultation Paper)

生态环境部于2026年8月4日公布《排污单位自行监测管理办法(征求意见稿)》。此前排污单位自行监测的制度框架主要由《污染源自动监控管理办法(2025)》和《排污单位自行监测技术指南 总则(HJ 819-2017)》两部分构成。征求意见稿将原来分散在技术指南和旧规章中的要求整合升格为一部统一的部门规章,实现自动监测与手工监测在同一部规章中的统一管理。

在责任分配方面,征求意见稿首次将排污单位明确为监测数据质量的第一责任人。排污单位委托第三方技术服务机构开展监测的,应当与受托机构直接签订委托合同,严禁将同一监测项目的采样、分析等环节拆分委托,受托机构不得转包、分包监测业务;同时,排污单位须安排专人对手工监测活动实施全程现场监督并签字确认,因未履行监督义务造成监测数据失真的,由排污单位依法承担相应法律责任,不得以“监测业务已外包”为由免责。

在监管手段方面,征求意见稿新增多项具备强制约束力的管理要求:自动监测点位需配套视频监控并联网;监测设备需具备防篡改功能;手工监测需使用具备定位授时功能的设备;原始监测记录保存不少于5年;自动监测数据每日公开、手工监测数据5个工作日内公开。

On August 4, 2026, the Ministry of Ecology and Environment released the Administrative Measures for Self-Monitoring by Pollution Dischargers (Consultation Paper). Previously, the institutional framework for self-monitoring by pollution dischargers consisted primarily of two parts: the “Administrative Measures for Automatic Monitoring of Pollution Sources(2025)” and the “Technical Guidelines for Self-Monitoring by Pollution Dischargers—General Provisions(HJ 819-2017)” The Consultation Paper consolidates and elevates the requirements previously scattered across technical guidelines and older regulations into a single, unified departmental regulation, thereby achieving unified management of both automatic and manual monitoring under the same regulatory framework.

Regarding the allocation of responsibilities, the Consultation Paper explicitly designates pollution dischargers as the primary parties responsible for the quality of monitoring data for the first time. When a pollution discharger commissions a third-party technical service provider to conduct monitoring, it must enter into a direct commission contract with the provider. It is strictly prohibited to split the sampling, analysis, and other stages of the same monitoring project into separate commissions, and the commissioned provider may not subcontract or sub-contract the monitoring services; At the same time, pollution dischargers must assign a dedicated person to conduct on-site supervision of manual monitoring activities throughout the entire process and sign off on the results. If monitoring data is distorted due to a failure to fulfill supervision obligations, the pollution discharger shall bear the corresponding legal liability in accordance with the law and may not claim exemption from liability on the grounds that “monitoring services have been outsourced.”

 In terms of regulatory measures, the Consultation Paper introduces several new management requirements with binding force: automatic monitoring sites must be equipped with video surveillance systems connected to a network; monitoring equipment must have tamper-proof features; manual monitoring must use devices with location and time-stamping capabilities; original monitoring records must be retained for no less than five years; automatic monitoring data must be disclosed daily, and manual monitoring data must be disclosed within five working days.

Water Law of the People’s Republic of China (Second Review Draft of the Amendment)

全国人大常委会公布《中华人民共和国水法(修订草案)》(二次审议稿)。二次审议主要围绕明确国家水网建设总体要求、衔接生态环境法典相关规定、优化流域规划编制要求、完善水资源节约保护机制等方面作出相关修改。

The Standing Committee of the National People’s Congress has released the “Water Law of the People’s Republic of China (Revised Draft)” (Second Review Draft). The second review primarily focused on clarifying the overall requirements for the construction of the national water network, aligning with relevant provisions of the Ecological and Environmental Code, optimizing requirements for the formulation of river basin plans, and improving mechanisms for water conservation and protection.

中华人民共和国道路交通安全法(修订草案)

Road Traffic Safety Law of the People’s Republic of China (Revised Draft)

全国人大常委会公布《中华人民共和国道路交通安全法(修订草案)》,这是该法施行22年来的首次系统性“大修”。修订草案主要围绕整治道路通行突出乱象、规范非机动车通行管理、增设自动驾驶专门规则、完善交通违法处罚机制等方面作出相关修改。

修订草案新增了“自动驾驶汽车的特别规定”一章,明确自动驾驶汽车、辅助驾驶功能的法律定义,确立不同驾驶状态下的分类管理原则,对自动驾驶模式下的通行规范、违法责任归属等作出了严格规范;同时调整电动自行车通行限速标准与安全防护要求,细化了“开门杀”防范、废弃车辆停放治理、占道非交通活动管控等规则,进一步健全道路通行秩序管理体系。

The Standing Committee of the National People’s Congress has released the “Road Traffic Safety Law of the People’s Republic of China (Revised Draft),” marking the first systematic major revision of the law in the 22 years since its implementation. The revised draft primarily introduces amendments aimed at addressing prominent traffic disorder, standardizing the management of non-motorized vehicles, establishing specific rules for autonomous vehicles, and improving the mechanism for penalizing traffic violations.

The draft amendment adds a new chapter titled “Special Provisions on Autonomous Vehicles,” which clarifies the legal definitions of autonomous vehicles and driver-assistance functions, establishes principles for classified management under different driving states, and sets strict regulations regarding traffic norms and the attribution of liability for violations in autonomous driving mode; at the same time, it adjusts speed limits and safety requirements for electric bicycles, refines rules regarding the prevention of “door-opening accidents,” the management of abandoned vehicles, and the control of non-traffic activities obstructing traffic lanes, thereby further improving the management system for road traffic order.

河南省工贸企业危险化学品安全管理暂行办法

Interim Measures for the Safety Management of Hazardous Chemicals in Industrial and Commercial Enterprises in Henan Province

办法适用于河南省范围内工贸企业生产、加工过程以及配套辅助设施涉及的危险化学品安全管理工作,覆盖危险化学品采购、装卸、储存、使用、应急管理全链条,并根据企业涉及危化品的种类、特性及总量,实行差异化监管。

规定将化工行业管理要求延伸至工贸领域,明确涉及重点监管危险化工工艺或构成重大危险源的企业,须建立安全包保责任制,并参照化工行业标准判定重大事故隐患。规定细化现场管理标准,要求专用储存柜储量不超过本岗位当班使用量且单柜不超50L或50kg,液化烃、液氯、液氨等不得采用软管输送。规划明确将变更管理纳入企业安全管理制度,要求对新工艺、新技术、新材料、新设备涉及危化品的变更进行审批。

These Measures apply to the safety management of hazardous chemicals involved in the production, processing, and supporting auxiliary facilities of industrial and trade enterprises within Henan Province. They cover the entire chain of hazardous chemical procurement, loading and unloading, storage, use, and emergency management, and implement differentiated supervision based on the types, characteristics, and total volume of hazardous chemicals managed by each enterprise.

 The regulations extend the management requirements of the chemical industry to the industrial and trade sectors, stipulating that enterprises involving key-regulated hazardous chemical processes or constituting major hazard sources must establish a safety accountability system and assess major accident hazards in accordance with chemical industry standards. The regulations refine on-site management standards, requiring that the capacity of dedicated storage cabinets does not exceed the amount used during a single shift at that workstation, with no single cabinet exceeding 50 liters or 50 kilograms. Furthermore, liquefied hydrocarbons, liquid chlorine, liquid ammonia, and similar substances must not be transported via hoses. The regulations explicitly incorporate change management into enterprise safety management systems, requiring approval for changes involving hazardous chemicals in new processes, technologies, materials, and equipment.

河南省工伤保险条例

Henan Province Work-Related Injury Insurance Regulations

针对2007年版条例施行近20年来参保范围窄、工伤预防制度缺位、工伤认定程序不够细化等问题,河南省人大常委会全面修订《河南省工伤保险条例》。新条例共八章六十一条,在结构上新增“工伤预防”专章,在制度上构建工伤预防、工伤补偿和工伤康复三位一体的工作体系。条例明确工伤保险基金实行省级统收统支,待遇计算基数由原来的“统筹地区上年度城镇非私营单位在岗职工月平均工资”统一调整为“全省上年度职工月平均工资”。

In response to issues such as a narrow scope of coverage, the absence of a work-related injury prevention system, and insufficiently detailed work-related injury determination procedures—which have persisted for nearly 20 years since the 2007 version of the regulations took effect—the Standing Committee of the Henan Provincial People’s Congress has revised the “Henan Provincial Work-Related Injury Insurance Regulations.”The new regulations consist of eight chapters and 61 articles. Structurally, a dedicated chapter on “Work-Related Injury Prevention” has been added, and institutionally, a three-pronged system encompassing work-related injury prevention, compensation, and rehabilitation has been established. The regulations specify that the work-related injury insurance fund shall be centrally collected and disbursed at the provincial level, and the basis for calculating benefits has been uniformly adjusted from the previous “monthly average wage of on-duty employees in urban non-private units in the pooled region for the previous year” to the “monthly average wage of employees throughout the province for the previous year.”

天津市非道路移动机械使用登记及排放监督管理办法

Tianjin Municipal Measures for the Registration and Emission Supervision of Off-Road Mobile Machinery

为对标《中华人民共和国生态环境法典》相关要求,进一步完善非道路移动机械全流程管控、细分场景管理、跨区域作业监管、部门协同治理等方面管理制度,天津市生态环境局修订印发《天津市非道路移动机械使用登记及排放监督管理办法》,构建覆盖机械生产销售、编码登记、现场使用、信息变更、维护检验、停用注销全生命周期的监管体系,明确多部门协同监管职责,形成从源头准入、过程管控到末端退出的闭环管理机制。

To align with the relevant requirements of the Ecological and Environmental Code of the People’s Republic of China and further improve management systems regarding full-process control of non-road mobile machinery, management of specific operational scenarios, supervision of cross-regional operations, and interdepartmental collaborative governance, the Tianjin Municipal Bureau of Ecology and Environment has revised and issued the “Measures for the Administration of Registration and Emission Supervision of Non-Road Mobile Machinery in Tianjin,” establishing a regulatory system covering the entire life cycle of machinery—including production, sales, coding and registration, on-site use, information updates, maintenance and inspection, and decommissioning and deregistration. The Measures define the responsibilities for multi-departmental collaborative supervision and establish a closed-loop management mechanism extending from market entry at the source, through process control, to decommissioning at the end of the life cycle.

广东省环境保护条例固体废物污染防治条例水污染防治条例大气污染防治条例全面修订

Guangdong Province’s Environmental Protection Regulations, Solid Waste Pollution Prevention and Control Regulations, Water Pollution Prevention and Control Regulations, and Air Pollution Prevention and Control Regulations Have Been Comprehensively Revised

2026年7月31日,广东省第十四届人大常委会第二十六次会议一次性修订通过了《广东省环境保护条例》、《广东省固体废物污染防治条例》、《广东省水污染防治条例》、《广东省大气污染防治条例》四部地方性法规,均自2026年8月15日起施行,与《中华人民共和国生态环境法典》同步生效。四部地方性法规对不符合、不衔接、不适应法典规定的条款进行全面梳理,聚焦广东省实际问题进行细化补充,形成“法典统摄、地方补位”的规范格局:

广东省环境保护条例:大幅精简与法典重复的通用制度,条文从73条简化至30条,新增海洋环境保护、土壤污染修复第三方监理、新污染物治理等条款;

广东省固体废物污染防治条例:要求建立全省统一固废数字化监管平台,强制推行污泥转移电子联单和环境污染责任强制保险,危废贮存期限不得超过一年,实验室危废纳入专项管理;  

广东省水污染防治条例:强化入河排污口全流程管理;明确工业园区污水设施联网监测,实行重点水污染物总量控制和排污许可管理。细化水功能区划分级编制与限期达标规划动态修编机制;

广东省大气污染防治条例:将珠三角区域产业禁限目录写入法条;VOCs纳入总量控制范围,管控延伸至台账五年保存。

On July 31, 2026, the 26th Session of the Standing Committee of the 14th Guangdong Provincial People’s Congress adopted a single package of amendments to four local regulations:

the “Guangdong Provincial Environmental Protection Regulations,”

the “Guangdong Provincial Solid Waste Pollution Prevention and Control Regulations,”

the “Guangdong Provincial Water Pollution Prevention and Control Regulations,” and

the “Guangdong Provincial Air Pollution Prevention and Control Regulations.”

All four regulations will take effect on August 15, 2026, concurrently with the Ecological Environment Code of the People’s Republic of China. The four local regulations comprehensively reviewed provisions that were inconsistent, incompatible, or unsuitable with the provisions of the Code, and refined and supplemented them by focusing on practical issues in Guangdong Province, thereby forming a regulatory framework characterized by “the Code providing overarching guidance, with local regulations filling in the gaps”:

Guangdong Provincial Environmental Protection Regulations: Significantly streamlined general provisions that duplicated those in the Code, reducing the number of articles from 73 to 30, and added new provisions on marine environmental protection, third-party supervision of soil pollution remediation, and the control of emerging pollutants;

Guangdong Provincial Solid Waste Pollution Prevention and Control Regulations: Require the establishment of a province-wide unified digital supervision platform for solid waste; mandate the use of electronic manifest for sludge transfers and compulsory environmental pollution liability insurance; limit the storage period for hazardous waste to no more than one year; and subject laboratory hazardous waste to specialized management;

Guangdong Province Water Pollution Prevention and Control Regulations: Strengthen end-to-end management of river discharge outlets; specify networked monitoring of wastewater treatment facilities in industrial parks; and implement total emission control for key water pollutants and discharge permit management. Refine the mechanisms for classifying and delineating water functional zones, as well as for dynamically revising plans to achieve compliance within specified timeframes;

Guangdong Province Air Pollution Prevention and Control Regulations: Incorporate the Pearl River Delta region’s industrial prohibition and restriction catalog into statutory provisions; include VOCs into the scope of emissions mass load control, with regulatory requirements extended to include the retention of records for five years.
