生态环境部办公厅:新化学物质环境管理登记办法(修订征求意见稿)

2026年生态环境部发布该修订征求意见稿,对现行《新化学物质环境管理登记办法》(部令第12号)进行系统性修订,并公开征求意见。此次修订的核心,不仅是将既有规则置于新法典框架之下,更是对制度逻辑进行全面重构,而非简单技术性调整。
与现行制度相比,修订稿在登记制度上体现出明显“收紧”:
一是取消备案类型,整体纳入更严格的登记管理程序,新化学物质年生产量或进口量不足1吨的办理简易登记(现行是备案),1吨以上的全部纳入常规登记类型(现行是10吨以上);
二是调整登记主体,仅允许境内生产或进口企业作为申请人,改变原有境外企业可代理申请模式。
三是适用范围调整,修订稿删除了原“不适用”的产品(如医药、农药、兽药、化妆品、食品、食品添加剂、饲料、饲料添加剂、肥料等产品),将其纳入新化学物质登记管理范围,扩大监管覆盖面。拟新增“用于科学研究和检验、检测、计量、监测等技术服务的化学物质”作为不适用类别。
在责任层面,处罚逻辑全面对齐生态环境法典,违法成本显著提高,责任范围进一步延伸至使用及供应链信息管理环节。该修订意味着新化学物质管理从“前端登记义务”向“全生命周期责任管理”转变,贯穿采购、进口、研发、销售的综合合规管理。
In 2026, the Ministry of Ecology and Environment released this draft amendment for public comment, systematically revising the current “Measures for Environmental Management Registration of New Chemical Substances” (Ministry Order No. 12). The core of this revision lies not only in placing existing rules within the framework of a new Ecological and Environmental Code, but also in fundamentally rethinking the underlying institutional logic—rather than merely making technical adjustments.
Compared to the current system, the revised draft shows a clear “tightening” in the registration system:
First, the filing-based registration type will be abolished and integrated into a more stringent registration management procedure. New chemical substances with an annual production or import volume of less than 1 ton will undergo a simplified registration process (currently, this is handled through filing). All substances exceeding 1 ton will be subject to the standard registration process (currently, this applies to those above 10 tons).
Second, the registration entity has been adjusted so that only domestical manufacturers or importers are allowed to apply, replacing the previous model where foreign companies could apply through an agent.
Third, the scope of application has been adjusted. The revised draft removes certain products previously deemed “not applicable” (such as pharmaceuticals, pesticides, veterinary drugs, cosmetics, food, food additives, feed, feed additives, fertilizers, and other similar products), bringing them under the new chemical substance registration management and broadening the regulatory coverage. It is proposed to add “chemical substances used for scientific research and technical services such as inspection, testing, metrology, and monitoring” as a new category of exemptions.
At the liability level, the penalty logic is fully aligned with the Ecological and Environmental Code, significantly raising the cost of violations and extending the scope of responsibility further to include the management of usage and supply-chain information. This revision signifies a shift in new chemical substance management—from a “front-end registration obligation” to “full-lifecycle responsibility management,” encompassing comprehensive compliance across procurement, import, R&D, and sales.

National Development and Reform Commission and four other departments: Notice on Issuing the “Guidelines for Accounting of Non-Fossil Energy Electricity Consumption (Trial)”
本指南为国家层面首次建立了可统一、可核查、可追溯的非化石能源电力消费核算规则。这将直接影响企业未来的碳核算、绿电采购、绿证应用、产品碳足迹以及ESG披露。
指南明确省级、地市及电力用户不同层级核算方法,统一提出非化石电力消费认定的三种方式(物理认定、交易认定、分摊认定),明确不同来源电量的归属规则。与此前各地区、各机制核算标准不统一的情况相比,该指南实现了全国层面的统一方法体系。以后企业究竟消费了多少“绿电”,不再是企业自己定义,而要按照国家统一规则核算,并作为电力消费间接碳排放核算的重要基础。
This guideline represents the first-ever nationally standardized, verifiable, and traceable accounting framework for non-fossil energy electricity consumption. It will directly impact enterprises’ future carbon accounting, green electricity procurement, green certificate utilization, product carbon footprints, and ESG disclosures.
The guideline clearly defines accounting methodologies for different levels—provincial, city, and power users—and uniformly proposes three approaches for recognizing non-fossil electricity consumption (physical recognition, transaction-based recognition, and allocation-based recognition), while also specifying the attribution rules for electricity from different sources. Compared to the previous situation in which accounting standards varied across regions and mechanisms, this guideline establishes a unified methodology system at the national level. Henceforth, the exact amount of “green electricity” consumed by enterprises will no longer be self-defined; instead, it will be calculated according to nationally standardized rules, serving as a crucial foundation for indirect carbon emissions accounting of electricity consumption.

Announcement on the Publication of the National Ecological and Environmental Standard “Technical Guidelines for Investigating and Remediation of Soil and Groundwater Pollution Risks in Key Supervised Units”
生态环境部发布《重点监管单位土壤和地下水污染隐患排查整治技术指南》,将于2026年8月15日起实施。新指南在确保环境风险防控效果的前提下,优化排查对象、简化成果材料,减轻企业负担,同时强化企业主体责任和隐患整治要求。
该指南是在2021年试行指南基础上修订形成的。生态环境部已推动1.7万余家重点监管单位开展隐患排查和“回头看”,但实践中仍存在对埋地储罐、池体、管道等隐蔽设施重视不足、排查手段单一、隐患判定和整治标准不清等问题。
新指南提出资料检查、目视检查、渗漏检测和土壤地下水监测4类排查方法,重点强化隐蔽设施渗漏检测要求;针对14类重点场所和11类重点设施设备,列出138种具体隐患情形及对应整治措施,为企业开展“照单排查、照单整治”提供明确依据。
The Ministry of Ecology and Environment has released the “Technical Guidelines for Investigating and Remediation of Soil and Groundwater Pollution Risks in Key Supervised Units,” which will take effect on August 15, 2026. The new guidelines, while ensuring effective environmental risk prevention and control, optimize the scope of inspections, simplify the required documentation, and reduce the burden on enterprises. At the same time, they strengthen enterprises’ primary responsibilities and enhance requirements for addressing potential hazards.
This guideline was revised and developed on the basis of the pilot guideline issued in 2021. The Ministry of Ecology and Environment has already guided more than 17,000 key supervised entities to carry out hazard identification and “look-back” reviews. However, in practice, there are still challenges such as insufficient attention to underground storage tanks, pools, pipelines, and other concealed facilities; limited inspection methods; and unclear standards for identifying and addressing hazards.
The new guidelines propose four categories of inspection methods: document review, visual inspection, leak detection, and soil and groundwater monitoring, with particular emphasis on strengthening requirements for detecting leaks in concealed facilities. For 14 key locations and 11 key types of facilities and equipment, the guidelines list 138 specific potential hazards along with corresponding remediation measures, providing clear guidance to conduct inspections and remediations according to a standardized checklist.
Ministry of Ecology and Environment: Notice on Optimizing the Format of Pollutant Discharge Permit (Copy)
生态环境部印发《关于优化排污许可证(副本)格式的通知》,对排污许可证内容和格式进行优化调整。新版排污许可证全面涵盖大气、水、工业固废、工业噪声、土壤等环境要素,各要素管理要求独立成章,分别记载其对应的污染物排放要求,形成大气分册、水分册、固废分册、噪声分册、土壤分册。同时形成“一口一表一码”格式,即每个排放口对应一张表和唯一二维码,实现信息集中展示与快速查阅,便于基层执法人员日常监管。
在6月25日生态环境部举行的6月例行新闻发布会上,生态环境部新闻发言人裴晓菲司长表示8月15日起,生态环境部将分行业分批次启动新版排污许可证更新工作,2026年底前实现全面应用。届时,现有排污许可管理企业无需重新填报,可直接登录全国排污许可证管理信息平台,自行下载新版排污许可证;首次申请企业则可直接申领新版排污许可证。
The Ministry of Ecology and Environment has issued the “Notice on Optimizing the Format of the Pollutant Discharge Permit (Copy),” implementing optimized adjustments to the content and format of the permit. The new version of the permit comprehensively covers environmental elements including air, water, industrial solid waste, noise, and soil. The management requirements for each element are presented in independent chapters, detailing the corresponding pollutant discharge requirements and forming separate booklets for air, water, solid waste, noise, and soil. Concurrently, a “one outlet, one table, one code” format has been established, wherein each discharge outlet corresponds to a dedicated table and a unique QR code. This structure enables centralized display and quick access to information, thereby facilitating routine supervision by frontline law enforcement personnel.
At the June regular press conference held by the MEE on June 25, Pei Xiaofei, Director of the Publicity and Education Department and MEE spokesperson, stated that starting August 15, the MEE will initiate the updating of the new version of the pollution discharge permit in batches by industry, with full application to be achieved by the end of 2026. At that time, enterprises already under pollution discharge permit management will not be required to resubmit their information; they can directly log in to the National Pollution Discharge Permit Management Information Platform to download the new version of the permit. First-time applicants will be able to directly apply for the new version of the permit.

从现有标准体系看,喷漆室安全已有《喷漆室安全技术要求》(GB 14444)等规范,而本征求意见稿重点定位于“检测方法与性能验证”层面。相较于现行标准侧重设备设计、结构及运行安全要求,本征求意见稿拟补充安全性能检测评价体系,强化对设备运行状态的客观检测。
The Ministry of Emergency Management has released this draft as a vital technical supplement to the safety supervision framework for spray booths. It complements existing safety technical specifications in the coating industry by focusing on safety performance testing requirements, thereby further refining the current technical specification system.
From the perspective of the existing standards framework, spray booth safety is already governed by specifications such as the “Safety Technical Requirements for Spray Booths” (GB 14444). In contrast, this draft specifically targets “testing methods and performance verification.” While current standards primarily focus on equipment design, structural integrity, and operational safety requirements, this draft intends to introduce a safety performance testing and evaluation system to strengthen the objective testing of equipment’s operational status.

Shanghai Municipal Administration for Market Regulation: Implementation Opinions on Strengthening Safety Supervision of Aging Pressure-Bearing Special Equipment in the Municipality
本实施意见针对老旧承压类特种设备提出更为系统的监管要求,重点聚焦服役年限较长的老旧承压类特种设备:
- 超设计使用年限(未规定设计使用年限,使用年限超过20年)的压力容器(含固定式压力容器和氧舱);
- 累计使用15年以上的锅炉;
- 符合《危险化学品生产使用企业老旧装置安全风险评估指南(试行)》界定的老旧装置范围内的GC1级压力管道;以及其他隐患风险较为突出的老旧承压类特种设备。
采用“企业自查+设备检验+风险评估+智慧监管”相结合的方式,严格落实使用单位主体责任和属地监管责任,构建全生命周期安全管控体系,强化老旧承压类特种设备安全管控。结合上海现行“日管控、周排查、月调度”机制,本意见进一步延伸了其在承压设备领域的实施深度。
The Implementation Opinions set forth more systematic regulatory requirements for aging pressure-bearing special equipment, with a focus on equipment that has been in service for an extended period:
- Pressure vessels (including stationary pressure vessels and hyperbaric oxygen chambers) that have exceeded their design service life (or, for those without a specified design life, have been in service for over 20 years);
- Boilers that have been in cumulative use for over 15 years;
- GC1-grade pressure pipelines that fall within the scope of aging equipment as defined in the “Guidelines for Safety Risk Assessment of Aging Installations in Enterprises Producing and Using Hazardous Chemicals (Trial)”; and other aging pressure-bearing special equipment with prominent hidden risks.
Adopting a combined approach of “enterprise self-inspection + equipment inspection + risk assessment + intelligent supervision,” these opinions strictly enforce the primary responsibility of the user entity and the local regulatory responsibility. The goal is to build a full life-cycle safety control system to strengthen the safety management of aging pressure-bearing special equipment. In conjunction with Shanghai’s existing “daily control, weekly inspection, and monthly scheduling” mechanism, these opinions further deepen its implementation within the field of pressure equipment.
浙江省发展改革委:浙江省固定资产投资项目节能审查和碳排放评价实施办法
Zhejiang Provincial Development and Reform Commission: Implementation Measures for Energy Conservation Review and Carbon Emission Assessment of Fixed-Asset Investment Projects in Zhejiang Province.
本办法将节能审查与碳排放评价制度进行整合,旨在强化固定资产投资项目源头管控。与以往单独开展节能审查的管理模式相比,办法新增碳排放评价要求,使项目审核从“能耗控制”扩展至“能耗+碳排放”双维度约束。
办法明确对年综合能源消费量1万吨标准煤及以上(或年煤炭消费量1万吨及以上)的项目和全部高耗能高排放项目同步开展碳排放评价。
The Measures integrate the energy conservation review with the carbon emission assessment system, aiming to strengthen source control over fixed-asset investment projects. Compared with the previous management model of conducting energy conservation reviews independently, the Measures introduce carbon emission assessment requirements, thereby expanding project approval from a single dimension of “energy consumption control” to a dual-dimensional constraint of “energy consumption plus carbon emissions.”
The Measures explicitly stipulate that carbon emission assessments shall be conducted concurrently for projects with an annual comprehensive energy consumption of 10,000 tons of standard coal equivalent or above (or an annual coal consumption of 10,000 tons or above), as well as for all high energy-consuming and high-emission projects.
上海市:关于组织开展2025年度上海市重点单位报送能源利用状况报告和温室气体排放报告以及能耗、碳排放总量和强度双控目标评价考核等相关工作的通知
Shanghai Municipality: Notice on Organizing the Submission of the 2025 Annual Reports on Energy Utilization and Greenhouse Gas Emissions, as well as the Assessment and Evaluation of Dual-Control Targets for Total Energy Consumption, Carbon Emissions, and Their Intensities, by Key Entities in Shanghai.
根据《上海市节约能源条例》《重点用能单位节能管理办法》《上海市碳排放管理办法》等规定,对重点用能单位实行节能目标责任制和节能考核评价制度,重点用能(排放)单位(重点单位)应当每年按时向政府管理节能和碳排放工作的部门报送上年度能源利用状况报告和温室气体排放报告。2025年上海市综合能耗5000吨标准煤及以上的重点用能单位总计930家。
该通知是“能耗双控逐步转向碳排放双控”制度转型落地的标志和地方样板。它是全国首次在省级层面对全部重点用能法人企业同步实施能耗双控、碳排放双控两套刚性考核,结束长期“能耗硬约束、碳排放仅统计不考核”的割裂管理模式,为全国各省市推进能碳一体化管控提供可复制的落地模板。
In accordance with the Shanghai Energy Conservation Regulations, the Measures for the Management of Energy Conservation in Key Energy-Consuming Entities, and the Shanghai Measures for Carbon Emission Management, a target responsibility system and an assessment and evaluation system for energy conservation are implemented for key energy-consuming entities. Key energy-consuming (and emitting) entities (hereinafter referred to as “key entities”) shall submit their annual reports on energy utilization and greenhouse gas emissions for the preceding year to the government departments responsible for energy conservation and carbon emission management on a timely basis each year. In 2025, the total number of key energy-consuming entities in Shanghai with a comprehensive energy consumption of 5,000 tons of standard coal equivalent or above reached 930.
The Notice marks the implementation of the institutional transition from “dual control over energy consumption” to “dual control over carbon emissions.”, serving as a local model. It marks the first time at the provincial level that both dual control of energy consumption and dual control of carbon emissions—are simultaneously enforced for all key energy-consuming entities. This initiative brings an end to the long-standing fragmented management model characterized by “rigid constraints on energy consumption, while carbon emissions are merely accounted for but not assessed.” It provides a replicable and actionable template for provinces and municipalities across the country to advance integrated management of energy and carbon.
Guangdong Province: Two Hazard Identification Guidelines for Chemical (Hazardous Chemical) Enterprises.
广东省应急管理厅印发该通知,发布两项专项隐患排查指引,分别为《广东省化工(危险化学品)企业防爆电气隐患排查指引》和《广东省化工(危险化学品)企业承压类特种设备安全附件隐患排查指引》。
两项指引聚焦化工企业典型高风险领域,针对防爆电气设备及承压设备安全附件两个关键风险环节开展专项技术规范。这一设置体现出对“关键设施和关键失效模式”的精准监管导向。
本指引采用“专项场景细分指引”的形式进行规范,基于安全生产相关法律法规及实际监管问题编制,强调结合典型隐患开展针对性排查。
The Guangdong Provincial Department of Emergency Management has issued a notice releasing two specialized hazard identification guidelines: the Guidelines for Hazard Identification of Explosion-Proof Electrical Equipment in Chemical (Hazardous Chemical) Enterprises in Guangdong Province and the Guidelines for Hazard Identification of Safety Accessories for Pressure-Bearing Special Equipment in Chemical (Hazardous Chemical) Enterprises in Guangdong Province.
These two guidelines focus on typical high-risk areas in chemical enterprises, providing specialized technical specifications for two critical risk segments: explosion-proof electrical equipment and safety accessories for pressure-bearing equipment. This arrangement reflects a targeted regulatory approach oriented toward “critical facilities and critical failure modes.”
These guidelines are structured as “scenario-specific sub-guidelines.” Developed based on relevant laws and regulations on work safety and practical regulatory issues, they emphasize conducting targeted hazard identification in conjunction with typical hidden dangers.
