Regulations on Ecological and Environmental Monitoring
《生态环境监测条例》是我国生态环境监测领域首部专门行政法规,该条例于 2025年10月17日经国务院第70次常务会议通过,将于 2026年1月1日起施行。
《条例》共7章49条,围绕公共监测、自行监测、技术服务机构、监督管理、法律责任等领域做出规范。从“监测分类、责任划分、流程规范、法律追责”四大维度,系统性解决了过往监测碎片化、数据质量难管控、主体责任不清晰等问题。
《条例》第三章明确了企业的生态环境自行监测的相关要求。提出企业应当按照有关规范和标准制定监测方案,主要监测点位要安装视频监控并联网,自动监测设备需与生态环境部门实时对接。同时要求企业建立数据质量管理制度,明确其负责人对数据真实性、准确性负责,并按照规定的期限保存自行监测的原始监测记录。
The “Regulations on Ecological and Environmental Monitoring” is the first specific administrative regulation in the field of ecological and environmental monitoring in China. The regulations were adopted at the 70th Executive Meeting of the State Council on October 17, 2025, and will come into force from January 1, 2026.
The Regulations consist of 7 chapters and 49 articles, covering areas such as public monitoring, self-monitoring, technical service institutions, supervision and management, and legal responsibilities. From the four dimensions of ‘monitoring classification, responsibility division, process specification, and legal liability’, it provides a systematic solution to the issues of fragmented monitoring, challenges in ensuring data quality , and unclear responsibilities.
Chapter III of the Regulations specifies the relevant requirements for enterprises’ self-monitoring. It madidates that enterprises should develop monitoring plans in accordance with relevant norms and standards, install and network video surveillance at the main monitoring points, and ensure that automatic monitoring equipment is connected in real-time with the local environmental authority. At the same time, enterprises are required to establish a data quality management system, assign responsibility for the authenticity and accuracy of monitoring data to designated personnel, and retain original self-monitoring records for the prescribed period.

Ministry of Industry and Information Technology: Catalog of Industrial Water-Saving Processes, Technologies and Equipment Encouraged by the State (2025 Edition)
2025版目录涵盖共性通用、钢铁、石化化工、纺织印染、造纸、食品、有色金属、皮革、制药、电子、建材、蓄电池、煤炭、电力等14个行业,涉及研发、产业化示范、推广应用三大类150项节水工艺、技术和装备,覆盖高耗水生产工艺替代、高效冷却或洗涤、废水循环利用、用水智能管控、非常规水利用、节水减污降碳协同等多元工业节水模式,形成“基础通用—行业专用—前沿引领”的三级节水技术装备体系。
《国家鼓励的工业节水工艺、技术和装备目录(2023年)》《高耗水工艺、技术和装备淘汰目录(第一批)》同时废止。
The 2025 edition of the catalog encompasses 14 industries, including common and general industries, steel, petrochemical, textile printing and dyeing, papermaking, food, non-ferrous metals, leather, pharmaceuticals, electronics, building materials, storage batteries, coal, and electricity. It involves 150 water-saving processes, technologies and equipment in three categories: research and development, industrialization demonstration, andpromotion and application. It highlights diverse industrial water-saving models such as the substitution of high-water -consuming production processes, efficient cooling or washing, wastewater recycling, intelligent water use management and control, non-conventional water use, and the integration of water-saving, pollution-reduction and carbon-reduction. Together, these form a three-tier system of water-saving technologies and equipment: basic and general – industry-specific – frontier-leading.
The “Catalog of Industrial Water-Saving Processes, Technologies and Equipment Encouraged by the State (2023 Edition)” and the “Catalog of High Water-Consuming Processes, Technologies and Equipment (First Batch)” are repealed simultaneously.

National Development and Reform Commission, State Administration for Market Regulation: Notice on Issuing the “Catalogue of Products Subject to Energy Efficiency Labeling in the People’s Republic of China (2025 Edition)” and Related Implementation Rules
国家发展改革委、市场监管总局组织制修订了相关产品能源效率标识实施规则,并对实行能源效率标识的产品目录进行了梳理,形成了《中华人民共和国实行能源效率标识的产品目录(2025年版)》及相关实施规则。
目录包含目前实行能效标识管理的38类产品的产品,并附有家用和类似用途厨房电器、永磁同步电动机、空气净化器、微型计算机、燃气灶具、高压三相笼型异步电动机、商用制冷器具等7类产品的能效标识实施规则。
The National Development and Reform Commission and the State Administration for Market Regulation have organized the formulation and revision of the implementation rules for energy efficiency labeling of relevant products and sorted out the catalogue of products subject to energy efficiency labeling, forming the “Catalogue of Products Subject to Energy Efficiency Labeling in the People’s Republic of China (2025 Edition)” and related implementation rules.The catalogue covers 38 product categories currently under the energy efficiency labeling management and includes the implementation rules for 7 categories of products, including household and similar kitchen appliances, permanent magnet synchronous motors, air purifiers, microcomputers, gas stoves, high-voltage three-phase cage induction motors, and commercial refrigeration appliances.
全国人民代表大会常务委员会:关于修改《中华人民共和国环境保护税法》的决定
NPC Standing Committee: Decision on Amending the “Environmental Protection Tax Law of the People’s Republic of China”
2025年10月28日第十四届全国人民代表大会常务委员会第十八次会议通过了《中华人民共和国环境保护税法》修正案。修改后的《环保税法》新增一条围绕挥发性有机物征税试点的法条,明确国务院可根据需求,对排放《应税污染物和当量值表》之外的挥发性有机物的企事业单位和其他生产经营者,开展环保税征收试点。试点实施办法由国务院制定并报全国人大常委会备案,自试点实施办法施行之日起五年内,就征收挥发性有机物环境保护税试点情况向全国人民代表大会常务委员会报告,并提出修改法律的建议。
The amendment to the “Environmental Protection Tax Law of the People’s Republic of China” was adopted at the 18th Meeting of the Standing Committee of the 14th National People’s Congress on October 28, 2025. The amended “Environmental Protection Tax Law” introduces a new provision on piloting the taxation of volatile organic compounds (VOCs). It is specified that the State Council may, as needed, carry out a pilot project for levying environmental protection taxes on enterprises, public institutions and other producers and operators that discharge VOCs not listed in the “Table of Taxable Pollutants and Equivalent Values”. The pilot implementation measures shall be formulated by the State Council and filed with the Standing Committee of the National People’s Congress. Within five years from the date of implementation of the pilot implementation measures, the State Council shall report to the Standing Committee of the National People’s Congress on the progress of the pilot VOC taxation and propose recommendations for amending the law.

全国人大常委会:生态环境法典法律责任和附则编(草案二次审议稿)
NPC Standing Committee: Liability and Supplementary Provisions Chapters of the Ecological and Environmental Code (Second Review Draft)
继2025年9月8日,《生态环境法典(草案)》的总则编、生态保护编和绿色低碳发展编草案提请常委会二次审议后,10月24日十四届全国人大常委会第十八次会议二次审议了生态环境法典污染防治编草案和法律责任和附则编草案。
法律责任和附则编草案二审稿进一步落实过罚相当原则,优化调整罚款相关规定。草案二审稿还增加了有关油烟污染、光污染的法律责任规定。
Following the submission of the drafts of the General Provisions, Ecological Protection, and Green Low-Carbon Development Chapters of the “Environmental Code (Draft)” for the second review by the Standing Committee on September 8, 2025, the 18th Meeting of the Standing Committee of the 14th National People’s Congress conducted the second review of the drafts of the Pollution Prevention and Control Chapter, as well as the Legal Liability and Supplementary Provisions Chapter of the Ecological and Environmental Code on October 24.
The second review draft version of the Legal Liability and Supplementary Provisions Chapter further implements the principle of proportionality between violations and penalties, optimizing and adjusting the provisions related to fines. It also introduces new provisions on legal liabilities for oil fume pollution and light pollution.
NPC Standing Committee: Pollution Prevention and Control Chapter of the Ecological and Environmental Code (Second Review Draft)
污染防治编草案二审稿对大气、水污染防治的规定进行了进一步细化,回应了当前污染防治的重点难点工作。二审稿新增规定要求重点行业企业定期开展隐患排查整治,采取有效措施防治重金属污染。同时规定建立健全产品的低挥发性有机物含量标识制度等内容。
The second review draft of the Pollution Prevention and Control Chapter further refines the provisions on the prevention and control of air and water pollution, addressing the key and challenging tasks in current pollution prevention and control.
It introduces new requirements for enterprises in key industries to regularly conduct hidden danger investigations and rectifications, take effective measures to prevent and control heavy metal pollution as well as establish and improve of a
labeling system for products with low volatile organic compound (VOC) content, along with other related requirements.
生态环境部:废弃电器电子产品处理污染控制技术规范(征求意见稿)
Ministry of Ecology and Environment: Technical Specifications for Pollution Control in the Treatment of Waste Electrical and Electronic Equipment (Draft for Comments)
本标准的适用对象是开展废电器处理活动企业,适用废电器在贮存、拆解、利用及处置等过程中的污染控制技术要求。标准可用于废电器处理等建设项目环境影响评价、环境保护设施设计、竣工环境保护验收及投产后的运营管理、排污许可证管理等环境管理活动。
本次修订细化了贮存过程中的污染控制要求和拆解过程污染控制要求,增加产物利用处置污染控制要求,并在附录清单中新增了其他类别废电器,包括服务终端类、智能消费设备类、医疗服务设备类(植入、感染及放射性设备除外)及小型办公设备类。
This standard applies to enterprises engaged in treatment of waste electrical and electronic equipment treatment. It specifies the technical requirements for pollution control during the storage, disassembly, utilization and disposal of such waste equipment. The standard can be used for environmental management activities including environmental impact assessment of construction projects related to waste electrical and electronic equipment treatment, design and acceptance of environmental protection facilities, post-commissioning operation management, and pollutant discharge permit administration.
This revision refines the pollution control requirements for storage and disassembly processes, introduces new requirements for pollution control during utilization and disposal of products, and expands the appendix list to include additional categories of waste electrical and electronic equipment. These new categories cover service terminals, intelligent consumer devices, medical service equipment (excluding implanted, infected and radioactive equipment) and small office equipment.
国家发展改革委:可再生能源消费最低比重目标和可再生能源电力消纳责任权重制度实施办法(征求意见稿)
National Development and Reform Commission: Implementation Measures for Minimum Renewable Energy Consumption Targets and Renewable Energy Power Consumption Responsibility Weighting System (Draft for Comments)
本办法规定了国务院能源主管部门将定重点用能行业,对其明确可再生能源电力消费最低比重目标和过渡期限,并进行监测、评价和考核。适用于能源用户可再生能源消费最低比重目标和省级行政区域可再生能源电力消纳责任权重的制定、监测和考核。
国务院能源主管部门按年下达可再生能源电力消费最低比重目标和非电消费最低比重目标,由省级能源主管部门会同相关行业主管部门组织落实。
供电企业、售电企业、相关电力用户和使用自备电厂供电的企业等承担可再生能源电力消纳责任,配合做好可再生能源电量消纳,提升可再生能源消纳能力。
未完成可再生能源消费最低比重目标的重点用能行业相关企业,由所在地省级能源主管部门促其在指标公布三个月内通过绿证交易或其他市场化交易方式补充完成,并及时上报国务院能源主管部门;逾期仍未完成的,予以约谈、通报,并纳入失信记录,加强重点监管。
The Measures stipulate that the national energy authority under the State Council shall identify key energy-consuming industries, set their minimum proportion targets for renewable energy power consumption and transition periods, and conduct monitoring, evaluation and assessment. They apply to the formulation, monitoring and assessment of the minimum proportion targets for renewable energy consumption of energy users and the renewable energy power
consumption responsibility weights of provincial administrative regions.
The national energy authority under the State Council shall issue annual minimum proportion targets for renewable energy power consumption and non-electricity consumption, which shall be organized and implemented by provincial energy authorities in conjunction with relevant industry authorities.
Power supply enterprises, power selling enterprises, relevant power users and enterprises using self-owned power plants for power supply shall assume the responsibility of renewable energy power consumption, cooperate in the renewable energy power integration, and enhance the capacity for renewable energy use.
For enterprises in key energy-consuming industries that fail to meet the minimum proportion target for renewable energy consumption, the local provincial energy authority shall urge them to make up the shortfall through green certificate trading or other market-oriented trading methods within three months after the announcement of the indicators, and promptly report to the national energy authority under the State Council. Those that still fail to comply within the time limit shall be interviewed, publicly notified, included in the dishonest record, and subject to intensified supervision.

Shandong Province: Implementation Measures for the Safety Director System of Production and EnterpriseEnterprises in Shandong Province
相较于2023发布的试行版本,本办法明确了应当设置安全总监的单位的从业人员数量要求,即从业人员100人以上的矿山、金属冶炼、交通运输、建筑施工、粉尘涉爆、涉氨制冷单位,危险物品的生产、经营、储存、装卸单位,使用危险物品从事生产并且使用量达到规定数量的高危生产经营单位,以及从业人员300人以上的其他生产经营单位。生产经营单位应将安全总监的任免书面报告地方安全生产监督管理职责的部门和应急管理部门。
安全总监应当按照规定向所在地负有安全生产监督管理职责的部门报告年度安全生产工作情况。本办法提高了安全总监的权限,要求生产经营单位作出下列涉及安全生产的决策之前,应征求安全总监的意见:安全生产投入计划;建设项目、拆除项目计划;重大设备、设施更新改造计划;生产工艺流程变更计划;生产经营场所布局调整计划及措施;生产经营场所、项目、设备的发包或者出租计划;常驻协作单位变更计划;关键装置、重点部位负责人员变动等。安全总监提出不同的书面意见且载明明确依据的,生产经营单位应当对决策事项依法重新论证。
Compared with the trial version issued in 2023, the Measures clarify the requirement on the number of employees for enterprises that shall appoint a Safety Director. Specifically, such enterprises include,mining, metal smelting, transportation, construction, dust explosion-related, and ammonia refrigeration-related units with 100 or more employees; units engaged in the production, operation, storage, and handing of hazardous substances; high-risk production and enterprises that use hazardous substances for production with usage reaching the specified quantity; and other production and enterprises with 300 or more employees. Production and enterprises shall submit a written report on the appointment or removal of the Safety Director to the local departments responsible for work safety supervision and emergency management.The Safety Director shall report the annual work safety situation to the local departments responsible for work safety supervision and administration in accordance with relevant provisions. The Measures enhance the authority of the Safety Director, requiring production and enterprises to solicit the Safety Director’s opinions before making decisions related to work safety, including: work safety investment plans; construction project and demolition project plans; major equipment and facility renewal and transformation plans; production process change plans; production and business site layout adjustment plans and measures; plans for contracting or leasing production and business sites, projects, or equipment; plans for changing resident cooperative units; and changes in responsible persons for key installations and key parts. If the Safety Director puts forward written opinions with clear justification that differs from the proposed decision, the enterprise shall re-assess the matter in accordance with the law.
Zhejiang Province: Implementation Plan for the Prevention and Control of Soil Pollution at the Source in Zhejiang Province
为全面贯彻落实生态环境部等七部委联合印发的《土壤污染源头防控行动计划》,加强土壤污染源头防控,浙江省生态环境厅会同省发展改革委、省经信厅、省财政厅、省自然资源厅、省建设厅、省农业农村厅制定了本方案。
实施方案将通过实施9项重点任务力争到2027年,土壤污染重点监管单位隐患排查整改合格率达到90%以上,受污染耕地安全利用率达到94%以上,建设用地安全利用得到有效保障。到2030年,各项指标进一步提升,形成多要素协同防治、多部门联动监管的土壤污染源头防控机制。
To fully implement the “Action Plan for the Prevention and Control of Soil Pollution at the Source” jointly issued by the Ministry of Ecology and Environment and six other central ministries and commissions, and to strengthen the prevention and control of soil pollution at the source, the Department of Ecology and Environment of Zhejiang Province, together with the Provincial Development and Reform Commission, the Provincial Department of Industry and Information Technology, the Provincial Department of Finance, the Provincial Department of Natural Resources, the Provincial Department of Housing and Urban-Rural Development, and the Provincial Department of Agriculture and Rural Affairs, has formulated this Plan.
Through the implementation of 9 key tasks, the Plan sets the following goals by 2027: the qualification rate of hidden danger investigation and rectification for key soil pollution supervision units reaches over 90%, the safe utilization rate of contaminated cultivated land reaches over 94%, and the safe utilization of construction land is effectively guaranteed. By 2030, all indicators will be further improved, and a soil pollution source prevention and control mechanism will be established, featuring multi-factor coordinated prevention and control and multi- department joint supervision.
