人力资源社会保障部办公厅等6部门:关于印发《工作场所女职工特殊劳动保护制度(参考文本)》和《消除工作场所性骚扰制度(参考文本)》的通知
Departments including the General Office of the Ministry of Human Resources and Social Security: Notice on Issuing the “Special Labor Protection Rules for Female Workers in the Workplace (Reference)” and the “Rules for Eliminating Workplace Sexual Harassment (Reference)”
两参考文本由人力资源社会保障部、国家卫生健康委员会等6个部门根据《中华人民共和国劳动法》《中华人民共和国劳动合同法》《中华人民共和国妇女权益保障法》《女职工劳动保护特别规定》《女职工保健工作规定》等法律法规及有关政策规定而制定。用人单位可在制定完善有关规章制度或与女职工签订劳动合同、集体合同时参考。用人单位可根据所在地地方性法规规定,结合实际对参考文本有关内容进一步细化完善。
《工作场所女职工特殊劳动保护制度(参考文本)》对工作场所女职工劳动就业保护、工资福利保护、生育保护、职业安全健康保护等核心内容进行列举。同时,对履行程序给出规范指引。
《消除工作场所性骚扰制度(参考文本)》对性骚扰定义及主要表现行为、公开承诺、宣传培训、职工举报投诉、调查处置、工会参与监督等主要内容予以明确。
These two reference documents were formulated by six departments including the Ministry of Human Resources and Social Security and the National Health Commission, in accordance with the “Labor Law of the People’s Republic of China”, the “Labor Contract Law of the People’s Republic of China”, the “Law of the People’s Republic of China on the Protection of Women’s Rights and Interests”, the “Special Rules on the Labor Protection of Female Employees”, the “Regulations on Health Care Work for Female Employees” etc. Employers can refer these documents when developing and improving relevant rules and procedures or coming into labor contracts and collective contracts with female employees. Employers can further refine and improve the relevant content of the reference documents according to local regulations and actual conditions.
The “Special Labor Protection Rules for Female Workers in the Workplace (Reference)” lists the core contents of labor and employment protection, wage and welfare protection, maternity protection, and occupational safety and health protection for female employees in the workplace. It also provides standardized guidance for the implementation procedures.
The “Rules for Eliminating Workplace Sexual Harassment (Reference)” clarifies the definition of sexual harassment and its main manifestations, public commitments, publicity and training, employee reporting and complaints, investigation and handling, and the participation and supervision by the labor union, etc.

方案确定上海市市职业卫生分类监督执法试点工作在上海市16个区开展。试点时间为即日起至2024年10月31日。
试点内容主要从用人单位职业病危害综合风险评估开始,市、区卫生监督机构按照用人单位职业病危害综合风险类别进行差异化监督执法。对丙类用人单位实行严格监管,有针对性提高抽查比例频次,实施现场检查;对乙类用人单位,按常规比例频次开展抽查;对甲类用人单位,合理降低抽查比例和频次,根据实际情况可不主动实施现场检查,实现“无事不扰”。
方案附件包括《用人单位职业病危害风险分级方法》、《用人单位职业卫生管理自查方法》、《用人单位职业病危害综合风险评估方法》、《用人单位职业病危害综合风险评估报告(模板)》。
The Plan plans to implement the pilot work of classified supervision and law enforcement of occupational health in Shanghai in 16 districts, starting from the issuance date to October 31, 2024.
The pilot scheme will start with the comprehensive risk assessment of occupational disease hazards by employers, depending on the risk assessment outcomes, the health supervision authorities at both municipal and district level shall conduct differentiated supervision and enforcement. Employers with Class C performance shall be strictly supervised, with higher frequency of spot checks and on-site inspections; For Class B employers, spot checks shall be conducted according to the regular basis; For Class A employers, the proportion and frequency of spot checks shall be reasonably reduced, and no proactive onsite inspection will be conducted in order to “not interrupt without the occurrence of specific events”.
The Plan includes several appendixes for reference, such as the “Classification Method for the Risk of Occupational Disease Hazards of Employers”, the “Self-inspection Method for Occupational Health Management of Employers”, the “Comprehensive Risk Assessment Method for Occupational Disease Hazards of Employers”, and the “Comprehensive Risk Assessment Report for Occupational Disease Hazards of Employers (Template).”
四川省生态环境厅办公室关于进一步加强重污染天气重点行业绩效评级工作的通知
评级范围在生态环境部规定的39个重点行业基础上,新纳入了金属表面处理及热处理加工、矿石采选与石材加工、肥料制造(不含煤制氮肥)、塑料制品、纸浆制造和造纸、沥青混合料搅拌站、有机化工、电子工业、汽修、通用行业等10个行业。
On the basis of national guidelines for 39 key industries specified by the Ministry of Ecology and Environment, Sichuan developed more local guidelines for ten industries to conduct environmental performance rating, so as to implement the differentiated emergency reduction mechanism during heavy air pollution weathers. Ten new industries include metal surface treatment and heat treatment processing, ore mining and stone processing, fertilizer manufacturing (excluding coal-based nitrogen fertilizer), plastic products, pulp manufacturing and papermaking, asphalt mixing plants, organic chemical industry, electronic industry, automotive repair, and one for general industry.
结合去年特殊作业票线上审查发现的普遍性、典型性问题,江苏省应急管理厅编制了《危险化学品企业特殊作业票证填写注意事项》,对动火安全作业票、进入受限空间安全作业票、临时用电安全作业票、高处安全作业票、盲板抽堵安全作业票、吊装安全作业票、动土安全作业票、断路安全作业票的填写和审批注意事项给出了详细指引。
同时要求自2023年6月1日起,所有重大危险源企业全部实行特殊作业票线上办理,采用特殊作业电子票。
Based on the common and typical issues found in last year’s online review of special work permit records, the Emergency Management Department of Jiangsu Province has compiled the “Precautions for Filling in Special Work Permits for Hazardous Chemical Enterprises”, which provides detailed guidance on the filling out and review of work permits, including work permits for hot work, confined spaces, temporary electricity safety, working at height, blinding pipeline, lifting, and excavation and road break.
It requires that from June 1, 2023, all enterprises with major hazard installations shall implement online processing of work permits using special e-work permit.
江西省:关于推动生产经营单位构建安全风险分级管控和隐患排查治理双重预防机制的指导意见
指导意见从落实责任、风险分级管控、隐患排查治理、加强综合治理几个方面分别提出了具体要求。
风险分级管控方面,指导意见特别要求矿山、危险化学品、烟花爆竹、交通运输、建筑施工、民用爆炸物品、金属冶炼等高危行业领域企业每年至少开展一次全面的安全风险辨识评估。要求生产经营单位建立完善安全风险公告制度,建立“一图一牌三清单”,即企业“红橙黄蓝”四色安全风险空间分布图、风险告知牌和风险管控责任清单、措施清单、应急处置清单。同时,重点岗位作业人员需签订岗位风险辨识管控确认书(包括上下工序及本工序风险辨识、防范措施、操作规程、应急处置等)。
The Guiding Opinions puts forward specific requirements in terms of responsibilities, hierarchical risk management and control, hidden danger inspection and treatment, and strengthening comprehensive management.
Regarding risk classification management and control, the Guiding Opinions specifically requires enterprises in high-risk industries such as mining, hazardous chemicals, fireworks, transportation, construction, civil explosives, and metal smelting industries to conduct a comprehensive safety risk identification and assessment at least once a year. Production and business entities are required to establish and improve the safety risk announcement system, and establish “one map, one board and three lists”, that is, the enterprise’s “red, orange, yellow and blue” four-color safety risk spatial distribution map, the risk notification board, the risk management and control responsibility list, the list of measures and the emergency response list. At the same time, workers in key positions need to sign a risk identification and control confirmation letter (including the risk identification of upstream, downstream and current working processes, preventive measures, operating procedures, emergency response, etc.).
征求意见稿Consultation Paper
相对于 2018 版《排污许可管理办法》,意见稿将排污登记单位以及限期整改排污单位纳入,增加了填报内容、主体责任以及管理部门具体监管内容。补充了执行报告以及自行监测记录相关要求。
意见稿细化了排污许可证的基本事项、登记事项、许可事项和管理要求,进一步规范流程。明确了持证排污单位和排污登记单位日常管理内容,强化排污许可的事中事后监管,推进“一证式”管理。
Compared to the 2018 version of the “Measures for Pollutant Discharge Permitting Administration”, the consultation paper incorporates pollutant discharge registration entities and pollutant discharge entities that need to be rectified within a specified period of time. It supplements reporting content, main responsibilities, and specific supervision requirement by authorities. It also adds relevant requirements for PDP implementation reports and self-monitoring records.
The consultation paper refines the basic items, registration items, licensing items, and management requirements of PDP, further standardizing the process. It also clarifies the daily management requirements for both PDP holders and PDR (pollutant discharge registration) entities, strengthens the post-PDP supervision to promote the “one Permit” management.
Ministry of Ecology and Environment: Radiation Safety Permit (Consultation Paper)
为配合《中华人民共和国放射性污染防治法》《放射性同位素与射线装置安全和防护条例》,以及《放射性同位素与射线装置安全许可管理办法》和《放射性同位素与射线装置安全和防护管理办法》修订工作,落实放射性同位素与射线装置分级分类管理要求,进一步推动核与辐射安全监管信息化建设,生态环境部辐射源安全监管司组织对《辐射安全许可证》格式与内容进行修订。
To implement the “Law of the People’s Republic of China on Prevention and Control of Radioactive Pollution”, “Regulations on the Safety and Protection of Radioisotopes and Radiation Devices”, and revised “Measures for the Administration of Safety Licensing for Radioisotopes and Radiation Devices” and “Measures for the Administration of Safety and Protection for Radioisotopes and Ray Devices”, Ministry of Ecology and Environment organized the revision of the format and content of the “Radiation Safety Permit”, aiming to implement the classification management for radioisotopes and radiation devices, and promote the digitalization of nuclear and radiation safety supervision.
国家发改委:《关于向社会公开征求<绿色产业指导目录(2023年版)>(征求意见稿)意见的公告》
为推动绿色发展的要求,各部门出台了一系列绿色产业的扶持政策。但由于“绿色”概念较为宏观、抽象,各部门对“绿色产业”的边界界定不一,存在泛绿化的现象。为此发改委等部门联合出台绿色产业指导目录,划定产业边界,协调部门共识。《绿色产业指导目录》首次在2019年印发,是各地区、各部门明确绿色产业发展重点、制定绿色产业政策、引导社会资本投入的主要依据,统一各地方、各部门对“绿色产业”的认识。《绿色产业指导目录(2023年版)》目前正在征求意见。新版目录分为节能降碳产业、环境保护产业、资源循环利用产业、清洁能源产业、生态保护修复和利用、基础设施绿色升级及绿色服务等七大类别。
In order to promote the requirements of green development, various competent authorities have issued a series of supporting policies for green industries. However, due to the macroscopic and abstract concept of “green”, “green industry” is defined ambiguously and differently by authorities, which may result in greenwash activities. The National Development and Reform Commission and other departments jointly issued a green industry guidance catalogue, in 2019, which was the main basis to clarify the development priorities of green industries, formulate green industry policies, guide social capital investment, and unify the understanding of “green industries” among all localities and departments. The Green Industry Guidance Catalogue (2023 Edition) is currently soliciting comments. The new catalogue expands and contains seven categories: energy conservation and carbon reduction industry, environmental protection industry, resource recycling industry, clean energy industry, ecological protection, restoration and utilization, green infrastructure upgrading and green services.
